HomeMy WebLinkAboutBZA 154-543 (901 Aviation)1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION BZA 154-543 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT ON PROPERTY LOCATED AT 901 AVIATION BLVD. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, California, at a public hearing held on February 6, 1984 in the Council Chambers at City Hall, considered the request of Mr. Barry Erlich for a conditional use permit for the sale of automobiles on the property located at 901 Aviation Blvd., legally described as Lots 3 & 4 of Tract 6917; WHEREAS, the Board after this review felt the request was consistent with the zoning and the general plan; and NOW, THEREFORE, BE IT RESOLVED that the Board of Zoning Adjustments does hereby approve a conditional use permit to allow the sale of used automobiles at property known as 901 Aviation Blvd., subject to the following conditions: 1. Designation of customer parking on the site. 2. Instal~ation of any lights to be reviewed by the Department of Building & Safety prior to any installation so as to insure that neighboring residential units will not be adversely affected. 3. Signing to be approved by the Department of Building & Safety. 4. No flags, banners or pennants will be allowed. 5. No exterior sound equipment on premises. 6. Installation of fire extinguishers as directed by the Fire Department. 7. No right turn from subject site onto Aubrey Court. 8. For the conditional use permit to be valid, the parking indicated for the existing commercial building (14 spaces) must be provided. ~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 9. Subject to review in six (6) months. 10. Failure to observe any conditions will be grounds for setting a hearing for revocation. 11. In the event that any one condition is found to be illegal or unenforceable by a court of competent jurisdiction, then the parties agree that all other conditions shall remain in full force and effect. The parties understand that the applicant is represented by counsel at all steps of these proceedings and it is the opinion of the City Attorney that the conditions meet Constitutional requirements, and in the event that either attorney is in error both parties agree that no action for damages shall be brought against the other party and that the exclusive remedy on behalf of the applicant is for a Mandate of Declaratory Relief to make the determination that any one or more conditions is illegal and unenforceable, and parties waive all rights to damages. 12. The hours of operation are not to exceed 8:00 A.M. to 9:00 P.M. on weekdays and 10:00 A.M. to 6:00 P.M. on weekends. AYES: Comms. Berardo, Corder, Cutler, Williams, Chmn.
