NO. 154-553 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 647 LONGFELLOW, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on March 5, 1984, in the Council Chambers of the City Hall, considered the request of Gerard & Barbra Huth for permission to add over 40% to an existing single family residence with a nonconforming rear yard of 2/2' in lieu of the 3' required and a nonconforming sideyard of 1.7' in lieu of the 3' required, on property legally described as Lot 40, So. Cal. Convention Hall & Marine View Tract; WHEREAS, as said public hearing, the following facts were presented for consideration: the project is located in the general plan designation of low density residential. ·The lot area is 2,500 sq. ft. The existing and proposed lot density is 17.42 du/ac. The existing lot coverage is 28%; the proposed lot lot coverage, 58%. The existing square footage is 724 sq. ft., and the square footage of the addition is 748 sq. ft.; WHEREAS, at said public hearing, the applicant's representative stated that the 2'2" rear yard is only a small portion of the rear of the site. The major portion of the back part of the house is in conformance with the Code. There is a 2'3" sideyard at the southeast corner of the building and the front of the building has a larger setback. The walls of the building are not quite perpendicular. A double-car garage will be added where only a single-car garage is existing. The project will remain under the allowable lot coverage and height limita- tion. WHEREAS, at said public hearing no one appeared in 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 opposition to the proposed variance. WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is granted, for the following reasons: 1) That there are exceptional or extraordinary circum- stances or conditions applicable to the property involved because the existing structure was built in 1939 and predated the existing Code. 2) That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone .because any modification of this property would require a variance; expansion of the property from the existing square footage, to a more typical square footage by today's standards~ is certainly a substantial property right that many other people in the same vicinity and zone have exercised. 3) That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the current sideyard variances are not an egregious problem, and this does not modify them in any way, the new construction being entirely within the Code; parking is up to Code. 4) That the granting of such variance will not adversely affect the comprehensive General Plan because the property is currently within the General Plan, and ·this variance does not change its use. //Ill -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, BE IT RESOLVED, that in view of the findings, the Board of Zoning Adjustments does hereby grant the ~a~iarr6e by th~ ·following vote: AYES: Comms.
