HomeMy WebLinkAboutBZA 154-554 (2041 Circle Dr)1 2 3 4 5 6 7 8 9 10 11 12 13 14 " 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION B.Z.A. 154-054 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRA'.NTINGA~VARIANCE ON PROPERTY LOCATED AT 2041 CIRCLE DRIVE, HERMOSA BEACH, CALIFORNIA, LEGALLY DESCRIBED AT LOT 15 & N'LY 5' OF LOT 14, TRACT 3853. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on March 19, 1984 in the Hermosa Beach Community Center, Room 12, considered the request of Jerry & Leslie Newton for permission to add to the first floor and add a new second floor to an existing single family residence; WHEREAS, at said public hearing, the following facts were presented for consideration: the variances necessary for this addition of 40% to a structure with nonconforming yards as follows1: 1) southerly sideyard of l.8 1 in lieu of the 3.5 1 required; 2) northerly sidyard of 3.2' in lieu of the 3.5 1 required; and 3) front yard of 1.6' in lieu of the 6.9' required. Maintain a non- conforming northerly sideyard of 3,2' with the addition (second story) in lieu of the 3.5' required and encroach to within 1.5' of the front property line with an extension of the garage in lieu of the 6.9' required; WHEREAS, at said public hearing, the applicants stated that the first and third variance requests were related to the ~ garage which is only large enough for one car instead of two and the second variance dealt with a small three-foot area on the northerly wall which will be eliminated. They would also be adding a parking space to the structure; WHEREAS, at said public hearing, no one appeared to speak in opposition to the project; WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance re~uest is 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 justified, for the following reasons: 1) That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the existing structure was built in 1941 which predates the existing Code. 2) That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone because any modification of this property would require a variance; this project will improve the property and make it more typical of today's standards; this has been a property right that many other people in the same vicinity and zone have exercised. 3) That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it does not change the density; the new construc- tion will bring the parking up to Code. 4) That the granting of such variance will not adversely affect the comprehensive General Plan because this variance does not change the use of the property. NOW, THEREFORE, BE IT RESOLVED that ~n view of the above findings of fact, the Board of Zoning Adjustments of the City of Hermosa Beach, California, does hereby grant the variance by the following vote: VOTE: AYES: NQES: ABSENT: //Ill Ill// Comms.
