HomeMy WebLinkAboutBZA 154-558 (2308 Manhattan Ave)RESOLUTION B.Z.A. 154-558 1 11 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTED A VARIANCE ON PROPERTY LOCATED 2 11 AT 2308 MANHATTAN AVENUE, HERMOSA BEACH, CALIFORNIA. 31 1 WHEREAS, the Board of Zoning Adjustments of the City of 4 11 Hermosa Beach, at a public hearing held on April 2, 1984, in the 5 11 Council Chambers of the City Hall, considered the request of 61 1 Mr. Robert R. Swick for permission to encroach 4 feet into the 7 11 required front yard setback in lieu of the 3 feet encroachment 8 11 allowed, on property legally described as Lots 8 & 9, Block 64 , 9 11 Eirst Addition to Hermosa Beach. 101 1 WHEREAS, at said public hearing, the following facts were 11 presented for consideration: that the request was for the appli~ 12 cant to encroach four feet into the required ;front yard setback in 13 lieu of the three feet · required with an ~xterior balcony at the 14 second level. The present building meets the required front 15 yard setback, Project will increase lot coverage from 54,6% to 16 11 56. 7%. 17 WHEREAS , at said public hearing, th~ applicant stated 18 11 that the eave overhang will not extend beyond th~ balcony because 19llhe is planning on changing the roof design. He noted that there 20llare many other properties in the general area that are right on 21 the property line and explained that when he bought the property, 22 he did not realize that the City owned four feet of the property, 23 WHEREAS, at said public hearing, no one appeared to speak 24l l in opposition to the project. 25 WHEREAS, after due consideration, it is the opinion of the 26 Board of Zoning Adjustments that the variance request is granted 27 for the following reasons: 28111. That there are exceptional or extraordinary circumstances • 1 or conditions applicable to the property involved because this 2 house is quite close to the front property line, 3 ,2. That such variance is necessary for the preservation and 4 enjoyment of a substantial property right possessed by other 511 property in the same vicinity and zone because it has become more 6 and more common to maximize outdoor space on the beach; the 7 construction of a reasonable deck falls under the substantial 8 property right. 911 3. That the granting of such variance will not be materially 10 detrimental to the public welfare or injurious to the property 11 or improvements in such vicinity and zone in which the property 121 1 is located because this is a very minor encroachment and is 13 mitigated to certain degrees by the limitation of the roof 14 overhang, 15 11 4, That the granting of such variance will not adversely affect 1611 the comprehensive General Plan because there is no change to the 1711 property under the General Plan and the property is currently 1811 within the definition of the General Plan, 19 NOW 1 THEREFORE, BE IT RESOLVED that in view of the above 2011 findings of fact, the Board of Zoning Adjustments of the City of 21 Hermosa Beach, California, does hereby grant the variance by the 22 following vote: 23 AYES: Comms, Berardo, Corder, Chmn, Moore 24 NOES: Comms, Cutler, Williams 25 ABSENT: None 26 I/Ill 27 II/II 28 I/Ill -2- " • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ( 27 28 CERTIFICATION I hereby certify that the foregoing Resolution B.Z.A. 154-558 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach, California, at a regular meeting held on the 2nd day of April, 1984.
