WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, California, at a public hearing held on May 21, 1984 in the Council Chambers at City Hall, considered the request of Mr. Raymond Greenough and Caroline Zehnpfennig for a conditional use permit for off-sale of beer and wine in conjunction with the sale of "gift baskets'', drn ,,•property legally described as Lot 21, Hi~s Addition to Hermosa Beach Tract; and WHEREAS, the Board after due consideration felt that the request was consistent with the zoning and the general plan~ and NOW, THEREFORE, BE IT RESOLVED that the Board of Zoning Adjustments does hereby approve a conditional use permit to allow the off-sale of beer and wine in conjunction with the sale of "gift baskets" at property known as 343 Pier Avenue, subject to the following conditions; 1. No alcoholic beverages shall be opened or consumed on the premises . 2. Beer and wine may be sold as part of "gift baskets 11 only and not separately. 3. All combustible materials used for lining the gift baskets such as cellophane, excelsior, shredded paper, etc. shall be kept in metal containers, 4. The Fire Departiman"b shall approve the amounts I heights, and location of all stored materials. 5. Approval shall be obtained from the L.A. Deliveries (incoming and outgoing) shall be limited to the rear of the building. 7. This permit is subject to review in six months. 8. In the event that any one condition is found to be illegal or unenforceable by a court of competent jurisdiction then the parties agree that all other conditions shall remain AYES: NOES: in full foree and effect. The p~rties understand that the applicant is represented by counsel at all steps of these proceedings and it is the opinion of the City Attorney that the conditions meet Constitutional requirements and in the event that either attorney is in error both parties agree that no action for damages shall be brought against the other party and that the exclusive remedy on behalf of the applicant is fbr a Mandate of Declaratory Relief to make the determination that any one or more conditions is illegal and unenforceable, and parties waive all rights to damages under the Civil Rights AC:t as promulgated by recent Supreme court decision.
