RESOLUTION B.Z.A. 154-565 111 A RESOLUTION OF THE BOARD OF ZONING ADJUST~~ENTS OF THE CI'::'Y OF HERMOSA BEACH, CALIFORNIA GRANTING A VARIANCE OP PROPER.TY LOCA'!'ED 211 AT 1838 THE STRAND, HERMOSA BEACH, CALIFORNIA. 31 1 WHEREAS, the Board of Zoning Adjustments of the City of 411 Hermosa Beach, at a public hearing held on the 21st df May, 1984, 511 in the City Hall Council Chambers, considered the request of 611 Dr. Paul Shank for permission to add a roofed second level 71 1 balcony which encroaches into the required front yard setback to &I I the property line in lieu of providing the required two foot 911 setback, on property legally described as Lot 7 , Block 19, 10 11 Hermosa Beach Tract, c:orrimonly known as 1838 St·ranct:; and 11 WHEREAS, at said public hearing the following facts were 121 1 presented for consideration: that the property is located in an 13 11 R-2, medium density residential zone; lot area is 2451 sq,ft,, 14 11 existing lot density is 35 1 5 du/ac, proposed lot density is 15 I I 17, 7 du/ ac, existing lot coverage is 62%, proposed lot coverage 161 1 is 6f1 %; and that the proposed second level balcony would 17 11 encroach to the front property line in lieu of providing the 18 11 two-foot required; and that the balcony would be located 19 11 approximately 6 r, behind the Strand wall and that the appliant 20 11 is also removing the rear garage and apartment and replacing it 21 11 with a new two-car garage with studio above~ ·and that the new 221 1 construction wi 11 conform with the Zoning Ordinance . and results 231 1 in a removal of a dwelling unit; and 241 1 WHEREAS, at said public hearing', a resident appeared to 25 I I speak in favor of the variance st at ing that he represented the 26 11 surrounding neighborhood and also the appl:Lcant submitted 14 27 11 signature of surrounding neighbors in favor of the request and • ' 28 11 i1:H.EREAS, at said public hearing no one appeared to speak :;fi3 1 opposition to the variance; and; 2 WHEREAS, after due consideration it is the opinion of the 3 Board of Zoning Adjustments that the variance be granted for the 4 following reasons: K 5 1. That there are exceptional or extraordinary circumstances 6 or conditions applicable to the property involved because the 7 residence was constructed before the:,current building code setbacks 8 were established, 9 2. That the variance is necessary for the preservation and 10 enjoyment of a substantial property right possessed by other propett y 11 in the same vicinity and zone because it would maximize the 12 usable space on the site I to create a building facade more in 13 keeping with the craftsman style architecture which is the 14 existing style architecture of the building, 15 3. That the granting of such variance will not be materially 16 detrimental to the public welfare or injurious to the property 17 or improvements in such vicinity and zone in which the property 18 is located because the surrounding neighbors have expressed that 19 it would be an asset to the c,ommuni ty, 20 4. That the granting of such variance will not adversely affect 21 the comprehensive General Plan because the reconstruction of the 22 rear unit will provide more parking and because th:is, w;ill b,ring 23 the· :r,n•opepty< 1n0Te into comp:Liance with the Gene;ral :Plan, 24 NOW, THEREFORE, BE IT RESOLVED THAT in view of the above 25 findings of fact, the Board of Zoning Adjustments of the City of 26 Hermosa Beach does hereby grant the variance subject to a deed 27 restriction, by the following votei 28 ~ 1 11 AYES: Comms.
