HomeMy WebLinkAboutBZA 154-567 (3220 The Strand)' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION B.Z.A. 154-567 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA GRANTING A VARIANCE ON PROPERTY LOCATED AT 3220 THE STRAND, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on the 2nd day of July, 1984, in the City Hall Council Chambers, considered the request of Mr. Peter Biche for pennission to add a deck and spa while remodeling a single family residence, which is property with a nonconforming use ( two unit in an R-1 zone) on property legally described as Lot 20, Block 1, Shakespeare Tract; and WHEREAS, at said public hearing the following facts were presented for consideration: the existing lot coverage is 57% and the proppsed lot coverage will be 65%; that there are presently two dwelling units on the property, one fronting on the Strand and an apartment over garage fronting on Hennosa Avenue; that the applicant wishes to add deck and spa to Strand residence; that the exceptions to the Zoning Ordinance are alterations to nonconforming use, northerly sideyard of 2.48' (at deck) in lieu of the 3! required and front yard of 4.83 1 in lieu of the 5.3' required; and WHEREAS at said public hearing the applicant stated that other properties in the same vicinity enjoy the same type of deck that he is requesting; and WHEREAS, at said public hearing, a neighbor appeard to speak in favor of the project stating that it is not a case of prolonging the fife of a nonconforming use but upgrading hazardous conditions; and WHEREAS, after due--constderati-on tt is _ t.he opinion of the Board of Zoning Adjustments the variance be granted for the following reasons: 1. That there are exceptional or extraordinary circumstnaces applicable to the property involved because the structural alterations are particularly minor, amounting to only a moderately small deck and the reconstruction of a closet. ~ ---::.~ ______., i. 1 2. That such variance is necessary for the preservation and enjoyment of a 2 substantial property right possessed by other property in the same vicinty and 3 zone because it is a substantial property right to keep your property in 4 good repair as opposed to necessarily expanding it; a variance happens to be 5 required in this case because of the definition of a structural alteration as 6 opposed to general maintenance. 7 3. That the granting of such variance will not be materially detrimental to 8 the public welfare or injurious to the property or improvements in such g vicinity and zone because there is virtually no change in the use of the 10 property with particular note that there is no public complaint that there 11 is a negative impact on the area from the nonconforming use. 12 4. That the granting of such variance will not adversely affect the 13 comprehensive General Plan because although this property is nonconforming in 14 regard to the General Plan, there is no increase in the nonconformity, and 15 the issue of length of time in which this nonconformance will continue to 16 exist is hight speculative, mere maintenance of the property cannot be said 17 with a certainty to significantly increase the life of a property opposed to 18 substantial investment in the expansion of the size of the project. 19 NOW, THEREFORE, BE IT RESOLVED that in view of the above findings 20 of fact, the Board of Zoning Adjustments of the City of Hermosa Beach does 21 hereby grant the variance by the following vote: 22 AYES: Comms.
