RESOLUTION B.Z.A. 154-569
1 II A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, APPROVING A VARIANCE ON PROPERTY LOCATED AT 245 -26TH STREET,
211 HERMOSA BEACH, CALIFORNIA.
3 WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach
4 California, at a public hearing held on August 20, 1984, in the Council Chamber
5 of the City Hall, considered the request of Stephen and Victoria Straw for per-
6 mission to raise existing building and add new two car garage below it, and to
7 add loft area of approximately 220 square feet above existing floor after it is
8 raised to become second story. The project would require exceptions to the
9 Zoning Ordinance by continuing nonconformity of sideyards, distance between
10 buildings, and useable open space at the property legally described as Lot 13,
11 Block 112, Shakespeare Tract.
12 WHEREAS, at said public hearing, the following facts were presented
13 llfor consideration: 1) nonconforming sideyards of 2.9' would be maintained in
14 lieu of the 3' required; 2) the distance between buildings would be maintained
15 at 5.7' in lieu of the 6' required; 3) the addition exceeds 40% of the area of
16 the existing structure which is nonconforming as to yards and useable open
17 space;
18 WHEREAS, at said public .hearing, the applicant stated that after
19 11 8:30 A.M. there is no parking left, and that he desperately needs a garage;
20 WHEREAS, at said public hearing, the single objection raised regard-
21 ing obstruction of ocean view was answered as being a concept which the Zoning
22 Code does not address;
23 WHEREAS, after due consideration, it is the opinion of the Board of
24 Zoning Adjustments that the variance request is approved for the following
25 reasons:
26 1. That there are exceptional or extraordinary circustances or conditions ap-
G 27 plicable to the_property involved because the building was built before existing
28 Code; the variances are extremely minor in nature; an older house is being pre-

1 11 served by bringing it up to the present code with regard to parking.
2 2. That such variance is necessary for the pr_eservation and enjoyment of a
3 substantial property right possessed by other property in the same vicinity and
411 zone because the applicant could not expand the house without the variance.
5 3. That the granting of such variance will not be materially detrimental to
6 the public welfare or injurious to the property or improvements in such vicini-
711 ty and zone in which the property is located because it does not change the use
811 and does not prevent access; the variances are so minor compared with the stan-
9 dards of the Zoning Code.
10 4. That the granting of such variance will not adversely affect the comprehen-
11 sive General Plan because it does not change the present use which is conform-
12 ing.
13 NOW, THEREFORE, BE IT RESOLVED that in view of the above findings of
14 fact, the Board of Zoning Adjustments of the City of Hermosa Beach does hereby
15 approve the variance by the following vote:
16 11 AYES: Comms. Berardo, Corder, Williams, Chmn. Moore
17 NOES: None
18 ABSENT: Comm. Cutler

20 I hereby certify that the foregoing Resolution B.Z.A. 154-569 was adopted by
21 the Board of Zoning Adjustments of the City of Hermosa Beach, California, at a
2211 regular meeting held on the 10th day of August, 1984.
