111 A RESOLUTION OF THE BOARD OF ZONING ADUSTMENTS OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED AT 625 MONTEREY BOULEVARD,
2 11 HERMOSA BEACH, CALIFORNIA.
3 WHEREAS the Board of Zoning Adjustments of the City of Hermosa Beach,
4 at a public hearing held on the 16th of July, 1984, in the City Hall Council
5 Chambers, considered the request of Wynn and Sharon Smith for permission to
6 add more than 40% to an existing single family residence with nonconforming
7 sid~yard. The new addition will conform to sideyard requirements. Property
8 is legally described as Lot 3, Tract 864.
9 WHEREAS, at said public hearing the following facts were presented
10 for consideration: that the residen~e is located in an R-3 zone and the
11 general plan designation is high density; that the existing lot coverage is
12 43% and proposed lot coverage would be 58%; the addition results in an 88%
13 addition tote structure; that the residence has a nonconforming northerly
14 sideyard setback of .74' in lieu of the 31 required; and that the addition
15 would compJy with a-l of the setback requirements, however it does exceed
16 the allowable 40% addition to structures with nonconforming yards; and
17 WHEREAS at said public hearing the applicant stated that the
18 15.2' section that encroaches is an origfoal part of the structure:and
19 not added on; and
20 WHEREAS, at said public hearing, no one appeared to speak in
21 opposition to the project; and
22 WHEREAS, after due consideration, it is the opinion of the
23 Board of Zoning Adjustments that the variance be granted for the following
24 reasons:
25 1. That there are exceptional or extraordinary circumstances or conditions
26 applicable to the property involved because the house predates the existing
27 Code; the encroach~mnt, although fairly clsoe to the property line, is only
28 15.2 feet in length and is at the second story level and has existed with-
out problems for may years.

111 2. That such variance is necessary for the preservation and enjoyment of a
211 substantial property right possessed by other property in the same vicinity
311 and zone because expansion of property has been found to be up to modern
411 standards for housing sizes and has been found to be a substantial property
511 right in Hermosa Beach, and no expansion of this property would be reasonably
61 1 possible without the granting of this variance.
711 3. That the granting of such variance will not be materially detrimental to
811 to the public welfare or injurious to the property or improvements in such
911 vicinity and zone in which the property is located because the new
10 11 construction meets the Code, and is, by definition, not injurious to the
111 1 property or public welfare; the existing incroachemnt is minor.
121 1 4. That the granting of such variance will not adversely affect the
'
13 11 comprhensive General Plan because the project currently meets the General
14 11 Pl an and is not changed by this request.
15 NOW, THEREFORE, BE IT RESOLVED that in view of the above fin4ings
1611 of fact, the Board of Zoning Adjustments of the City of Hermosa Beach does
1711 hereby grant the variance by the fo 11 owing vote:
