A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 525 -24th PLACE,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, .at a
public hearing held on April 4j 1983, in the Council Chambers of the City Hall,
considered the request of Mr. and Mr~. Andrew Clifton for permission to add
more than 40% to an existing single family residence with nonconforming side-
yards and to maintain the nonconformity with the addition and to exceed the
allowable hieght limit of 25 feet; on property legally described as Lot 11,
Block 2, Hermosa Park Tract; and
WHEREAS, at said public hearing ~ the foll6wing facts were pr~sented for consideration;
that the property is in the R-L lm-1 density residential zone : that the existing
and proposed lot density is 6.97 du/ac ; that the existing lot coverage is 43.19%
and the proposed lot coverage is 44.09%i ·that the existing square footage is
2460 sq. ft. and proposed is 1285 sq. ft.; that the easterly nonconforming
sideyard varies from 4.7' to 4.8' and the westerly nonconforming sideyard varies
from 4.9' to 6.0 1 in lieu of the required 51 setback; and the applicants request
permission to exceed the allowable height limit of 25' by 3 1 at the peak of the
roof; and
WHEREAS, at said public hearing, the applicant stated that the lot slopes off
toward the back and that in the front of the house the addition is within the
25 1 height limit; and that according to the survey the house is 1½' below street
level. He noted because they wished to match the existing roof line that it is
difficult to stay within the hieght limit; and
WHEREAS, at said public hearing, no one appear~d to speak in opposition to the
variance; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust-
ments that the variance is justified, for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because since the original house was
built with the level rather than the step down floor on a lot that slopes to
the south, in order to sty within the hieght limit, the applicants would have
to violate the lines of the existing building by flattening the roof line or
to continue it, the applicant would have to have an exception to the height
limit; because of the area where the house is, this will not affect lignt,
air, shadow, or the other properties in any way ; because the variance is
only required for 19 owt of 125 feet of total length, and the height is
exceeded only along the very center line of the property; because at the
eaves of the structure, the roof will be within the height limit to minimize
the effect of a very tall wall on the neighbors.
2. That the variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because the same situations
have existed, and the Board has approved height limitation changes in that
vicinity and zone previously, hence, granting a privilege to others that the
Board would deny to the applicant if this were not allowed.

3. That the granting of such variance will not be materially detrimental
to the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located because bu allowing
this addition, the building will be more aesthetically pleasing ; because
residents in the area have supported the proposal.
4. · That the granting of such variance will notadversely affect the compre-
hensive General Plan because tt has no effect on the general plan.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact
the board of Zoning Adjustments of the City of Hermosa Beach does hereby
grant the variance by the fol lm•.Jing vote :
