HomeMy WebLinkAboutBZA 154-506 (1605 PCH)~"' RESOLUTION B.z.A: 154-506 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA REACH GRANTING A CONDITIONAL USE PERMIT ON PROPERTY LOCATED AT 1605 PACIFIC COAST HIGHWAY, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on May 2, 1983 in the Council Chambers of the City Hall, considered the request of Mr. Joseph Rocha for a conditional use permit for off-sale general liquor in conjunction with a liquor store, on property legally described as Lot 13, Block 81, Second Addition to Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration: that the property is located in the C-3 zone, multi-use corridor; that the hours of opertion proposed are 7 a.m .. to 2 a.m.; that the anticipated customer volume will be 300 people; and that the available off-street parking is 5 spaces and 2 onstreet spaces in front; it was noted that staff recommended six conditions if the Board acts to approve the request; and Whereas, at said public hearing the applicant was present to answer any questions; and WHEREAS, at said public hearing no one appeared to speak in opposition to the conditional use permit; NOW~ THEREFORE, BE IT RESOLVED, that the Board of Zoning Adjustments does hereby approve a conditional use permit to allow the sale of off-street general liquor ~n conjunction with a liquor store at 1605 Pacific Coa5t Highway, subject to the following conditions: 1. That the cashier's counter be located so as to be visible from Pacific Coast Highway for the purposes of police protection. 2. That no alcoholic beverages may be opened or consumed on the premises. 3. That the parking area be posted 11 No alcoholic beverages to be consumed on the premises.11 4. Operator of the business must police the areas directly adjacent to the business for litter and maintain in a clean and orderly manner on a daily basis. 5. Subject to review in six months. 6. In the event that any one conmition is found to be illegal or unenforceable by a court of competent jurisdiction, then the parties agree that all other conditions shall remain in full force and effect. The parties understand that the applicant is represented by counsel at all steps of these pro- ceedings and it is the opinion of the City Attorney that the conditions meet constitutional requirements, and in the event that either attorney is in error both parties agree that no action for damages shall be brpught aganist the other party and that the exclusive remedy on behalf of the applicant is for a Mandate of Declaratory Relief to make the determination that any one or more conditions is illegal and unenforceable, and parties waive all rights to damages. -1 - r ;. ~ '----- ,,.
