A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF : ••
HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED
AT 938 -14th STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of
Hermosa Beach, at a public hearing held on May 16, 1983, in the
Council Chambers at City Hall to consider the request of
Leslie Neff for permission to 1) add more than 40% (1st & 2nd
stories) to an existing single family residence with a nonconform-
ing easterly sideyard of 3.05' in lieu of the 5' required and 2)
add a parking space within the front fifty feet of the lot which
is not within a garage (carport), for property legally described
as Lot 12, Block 2, Hermosa Knob Hill Tract; and
WHEREAS, at said public hearing, the following facts
were presented for consideration: that the property is located
in the R-2 zone, low density residential; lot size is 50'x 74.54'
and .lot area is 3,727 sq. Jt.; existing and proposed lot density
is 11.68 du/ac; existing lot coverage is 30.57% and proposed lot
coverage is 57.11%; existing square footage is 940 sq. ft. and
proposed square footage is 1506 sq. ft.; and all of the setbacks
for the new construction comply with the Zoning Code requirements;
WHEREAS, at said public hearing, the applicant stated that
her main reason for adding on is for her mother to move in;
WHEREAS, at said public hearing, no one spoke in opposi-
tion to the project;
WHEREAS, after due consideration, it is the opinion of the
Board of Zoning Adjustments that the variance request is justified
for the following reasons:
1. That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved because to build

anything on this property would require a variance unless the
original building were torn down; the original building was
built prior to the current zoning laws and was apparently legal
at the time it was built; the variance requested is relatively
minor in that the building already meets the minimum sideyard
requirement of three feet; it is the total lot width that
causes it to be out of Code.
2. That such variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity and zone and denied to the property
in question because to expand this building, a variance is
required; there is no other practical way to add on to this
building other than to permit a variance to maintain the existing
sideyard.
3. That the granting of such variance will not be materially
detrimental to the public welfare or injurious to the property or
improvements in such vicinity and zone in which the property is
located because the new construction does meet Code and the old
construction provided minimum access for fire and safety personnel~
4. That the granting of such variance will not adversely affect
the comprehensive General Plan because it does not change the usei
there is some marginal protection granted to the City that the use
will not change because of demonstrated neighbor vigilance and a
deed restriction that will be placed on the property.
AND FURTHER, that the variance is granted subject to the
following:
That a deed restriction be placed on the said property
limiting the property to R-1 use only.

NOW, THEREFORE, BE IT RESOLVED that in view of the above
findings of fact, the Board of Zoning Adjustments of the City of
Hermosa Beach, California, does hereby grant the variance by the
following vote:
AYES: Comms. Corder, William, Chmn. Moore
NOES: None
ABSENT: Comms. Cutler, Toth
CERTIFICATION
I hereby certify that the foregoing Resolution B.Z.A. 154-510 was
adopted by the Board of Zoning Adjustments of the City of Hermosa
Beach, California, at a regular meeting held on the 16th day of
May, 1983.
