HomeMy WebLinkAboutBZA 154-511 (1110 21st St).,_ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 1-7 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION B.Z.A. 154-511 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED AT 1110 -21st STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on June 20, 1983, in the Council Chambers of the City Hall, considered the request of Dennis & Cheryl Marchand for permission io .add to an existing single family dwelling with nonconforming yards with said addition to be within 7" of the easterly property line, on property legally describ~d as Wly. 44' of Ely. 56.07' of Lots 78, 79, & 80, Walter Ransom Co. 's Redondo Home Tract; WHEREAS, at said public hearing, the following facts were presented for consideration: that this dwelling was constructed in 1952 and was not correctly located on the lot. The structure encroaches onto the adjacent easterly lot by 5.8 feet. The Genera Plan designation is low density residential. The existing and : proposed lot density is 12.97 du/ac. The existing lot coverage is 34.36% and the proposed lot coverage is 46.48%. The percentage of the addition is 35.25%; WHEREAS, the applicant's representative was present to speak on behalf of the proposed variance; WHEREAS, at said public hearing, no one appeared to speak in opposition to the project; WHEREAS, after due consideration, it is the opinion of th Board of Zoning Adjustments that the variance request is justified for the following reasons: 1) That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the home was built in 1952 in apparent error relative to the property line, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 which has been found to be a relatively common occurrence in Hermosa Beach; it is a particularly large lot; the encroachment asked for is extremely minor, being only a few inches extra extension towards the sideyard at only one point along the perimeter of the house; this encroachment is by no means as much as already exists elsewhere in the house. 2) That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because in order for any construction of this house, a variance is necessary. 3) That the granting of such variance ·will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because there is no significant change in access to this property; there is no impact on the free circulation of air or light as a result of this plan. 4) That the granting of such variance will not adversely affect the comprehensive General Plan because the use does not change. NOW, THEREFORE, BE IT RESOLVED that in view of the above findings of fact, the Board of Zoning Adjustments of the City of Hermosa Beach, California, does hereby grant the variance by the following vote: AYES: NOES: ABSENT: /Ill Ill/I Ill/I Comms.
