HomeMy WebLinkAboutBZA 154-513 (322 30th St), 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION B.Z.A. 154-513 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED AT 322-30TH STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, California, at a public hearing held on June 20, 1983, in the Council Chambers of the City Hall, considered the request of Mr. Lee A. Hennis for permission to add over 40% to an existing single family dwelling with a nonconforming side yard setback of 2.6 feet in lieu of the 3 feet required and to maintain the nonconforming setback with the addition (second story), legally described as Lot 28, Block 115, Shakespeare Tract; WHEREAS, as said public hearing, the following facts were presented for consideration: the general plan designation is medium density residential, lot size is 30' x 80,5, lot area is 2,415 sq. ft., existing lot coverage is 51.5% and proposed lot coverage is 62.69%. The percentage of the addition is 54%; WHEREAS, as said public hearing, the applicant's repre- sentative stated that the applicant is requesting the variance due to an already existing nonconforming side yard. The setback on the east side is 4/10' short of the required three feet. The applicant needs the variance to add on to his home; WHEREAS, at said public hearing, no orie appeared to speak in opposition to the project; WHEREAS, ~fter due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1) That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because this house was built before current codes; the variance requested is d-2 ' .J ; 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 exceedingly minor and does not extend the ground footprint of the property being only at the second story level. 2) That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone because to expand this house in a way that many others have done in the same vicinity and zone would require a variance; there is no alternate construc- tion that would void the need for a variance other than the owner tearing down the house; 3) That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because this is a minor construction project taking place only at the second story level; it will not affect ground access or significantly affect air and light circulation; 4) That the granting of such variance will not adversely affect the comprehensive General Plan because this project does not change the use of the property. NOW, THEREFORE, BE IT RESOLVED that in view of the above findings of fact, the Board of Zoning Adjustments of the City of Hermosa Beach, California, does hereby grant the variance by the following vote: AYES: NOES: Comms.
