RESOLUTION B.Z.A. 154-520 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 244 -29th STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 15, 1983, in the Council Chamners of the City Hall, considered the request of Nancy Wolf for permission to convert an existing duplex to a single family residence; and to maintain a nonconforming easterly sideyard which varies from 2.48' to 2.52' with a loft addition in lieu of the 3' required, on property legally described as Lot 16, Block 114, Shakespeare Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration: that the property is located in the R-2 zone, medium density residential; that the lot size is 30' x 80'; that the existing lot coverage is 60.5% and the proposed lot coverage is 64%, that the existing floor area is 1824 sq. ft. and the pro- posed floor area is 292.25'; and that the purpose of the variance is to utilize the existing exterior bearing walls for support; and conversion of this duplex into a single family residence will conform with the General Plan density for this area; and WHEREAS, at said public hearing the applicants' architect stated that there is a 2½' setback on one side of the building and a 3½1 setback on the other side and to conform to the 3' setbact require- ment would be expensive and visually unattractive; and WHEREAS, at said public hearing no one appeared to speak in opposition of the variance; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the request is justified for the · following reasons: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved because this building predates the Zoning Code; a minor error in building citing on a lot and apparently other lots in the same n~ighbor- hood was only recently discovered; and construction wou1~ either have to be on the existing walls or would require a complete teardown. 2. That such variance is neeessary for thi preservation an4 enjoyment of a substantial property right possessed by dther property in the same vicinity and zone, and denied to the property in question because to expand this property would require a variance to expand it to the same degree that otl houses in the same vicinity and zone have been expanded ' • Page•2 -BZA Resolution 154-520 3. That the granting of such variance will not be materially detrimental to public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because nothing involved in this project would affect in any way the light, safety personnel access, etc. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because the variance will bring the property mor into conformity than what is expected under the General Plan. · NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact the Board of Zoning Adjustments of the City of Hermosa Beach does hereby grant the variance by the following vote: AYES: NOES: ABSENT: Comms. Williams CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-520 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 15th day of August 1983.
