A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED
AT 237 -31st STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of
Hermosa Beach, at a public hearing held on September 19, 1983,
in the Cou~cil Chambers of the City Hall , considered the request
of Mr. William Hedderich for permission to maintain a nonconformin
front yard of 0' with a deck at the second story level in lieu of
the 3' required sideyard and 7' required frontyard; enclose a
po~ch at the first story maintaining a 0' frontyard setback in
lieu of the 7' required; and provide a stair and landing in the
required sideyard which does not return to grade, for property
legally described as Lot 13, Block 117, Shakespeare Tract;
WHEREAS, at said public hearing, the following facts
were presented for consideration: that the project is in the R-1
zone, medium density residential; lot si~e is 30' X 70'; lot area
is 2100 sq. ft.; existing & proposed lot coverage is 60.5%;
existing square footage is 1208 sq. ft.; and the proposed square
footage is 118 sq. ft. The existing building now encroaches
over the front property line onto City property a variable distanc
of .06' to .20' and portions of the proposed decks and stairs are
located on City property so an encroachment permit hearing by the
City Council would be necessary;
WHEREAS, at said public hearing, the applicant stated
that the total foundation is at 0' clearance and requested
permission to enclose the front porch entrance.
WHEREAS, at said public hearing no one spoke in opposi-
tion to the project;
WHEREAS, after due consideration, it is the opinion of

of the Board of Zoning Adjustments that the variance request is
justified, for the following reasons:
1) That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved because this house
was built at a time when it predates the Zoning Code; the house is
on a walk street which is materially different as far as front yar
encroachment is concerned; the construction itself maintains the
existing walls at the ground story level and will not affect the
encroachment at that level.
2) That such variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other
property in the same vicinity because many other properties in the
same vicinity and zone hive been granted variances in order to
increase the size df their homes, especially in cases where the
outer perimeter of the walls are not moved.
3) That the granting of such variance will not be materially
detrimental to the public welfare or injurious to the property
p r improvements in such vicinity and zone in which the property
is located because there is no material change to the property
t hat would affect public welfare, access of safety offficers, or
l ight and air circulation in the general vicinity.
) That the granting of such variance will not adversely affect
he comprehensive General Plan because this variance does not
change the use of the property.
NOW, THEREFORE, BE IT RESOLVED that in view of the above
f indings of fact, the Board of Zoning Adjustments of the City of
He rmosa Beach does hereby grant the variance by the following vote:
