HomeMy WebLinkAboutBZA 154-522 (3335 Highland)1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION B.Z.A. 154-522 A RESOLUTION OF THE BOARD OE ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED AT 3335 HIGHLAND, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on September 19, 1983, in the Council Chambers of the City Hall, considered the request of John & Lynn Carroll for permission to maintain a nonconforming distance of 3.1 ft. with a first and second story addition, in lieu of the 6 ft. required between the main building and a detached garage, for property legally described as Lot 18, Block 119, Shakespeare Tract; WHEREAS, at said public hearing, the following facts were presented for consideration: the property is located in the R-2 zone, medium density residential; lot area is 3318.78 sq. ft.; existing and proposed lot density is 13.12 du/ac; existing lot coverage is 38% and proposed is 44%; existing square footage is 1692 sq. ft. and proposed square footage of addition is 409 sq. ft.; WHEREAS, at said public hearing, the applicant was present to answer questions; WHEREAS, at said public hearing, no one appeared to speak in opposition to the project; WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1 • That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the two buildings are already within 3.1 ft. of each other and that their placement predates current Zoning Code; the addition extends that q-1_8 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 variance by only a small amount and does not otherwise change the building. 2 • That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone because a reasonable expansion of this house enjoyed by others in the same vicinity and zone would necessitate that this variance be grantedo 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because there is no apparent effect of any sort on the public welfare and no input from City staff to the contrary. 4 . That the granting of such variance will not adversely affect the comprehensive General Plan because the use of the property is not changed under the General Plan. NOW, THEREFORE, BE IT RESOLVED that in view of the abov findings of fact, the Board of Zoning Adjustments of the City of Hermosa Beach, California, at a regular meeting held on the 19th day of September, 1983, acted to grant this variance by the following vote: AYES: NOES: Comms. Berardo, Corder, Cutler, Williams, Chmn.
