HomeMy WebLinkAboutBZA 154-527 (527 3rd St),,. i RESOLUTION B.Z.A. 154-527 111 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 527-3RD 2l l sTREET, HERMOSA BEACH, CALIFORNIA. 3 WHEREAS, the Board of Zoning Adjustments of the City of 4\\Hermosa Beach, at a public hearing held on September 18, 1983, in 5 \\the City Hall Council Chambers considered the request of Ralph & 6 \\Carol Riemer for permission to alter a duplex by adding a sundeck 7 on the second level, on property legally described as Lot 37, 8 Tract 451; 9 WHEREAS, at said public hearing, the following facts 10\ \were presented for consideration: that the property is located in 11 \\an R-1, medium density residential zone, lot area is 2500 sq, ft.; 12 1 lexisting lot coverage is 22% and proposed is 55%, and the applican 13 I I is requesting permis$ion to struct·urally alter a duplex which is 14\\nonconforming as to use with the addition ot a sundeck at the 15 I I second level; 16 WHEREAS, at said public hearing , the applicant wa$ 17 I I present to answer quest ions regarding the project; 18 WHEREAS , at said public hearing no one appeared to 19 11 speak in opposition to the project; 20 WHEREAS, after due consideration, it is the opinion of 21 tbe Board of Zoning Adjustments that the variance request is 22 granted for the following reasons: 23 1 . That there are exceptional or extraordinary circumstances or 24 conditions applicable to the property involved because it is a 25 minor request, that being, a sundeck. 26 2. That such variance is necessary for the preservation and 27\\enjoyment of a substantial property right possessed by other 28\\property in the same vicinity and zone because it is a reasonable -q43 r i l ll development of a property to provide decks for the outside and 2 11 enjoyment. 31 13. That the granting of such variance will not be materially 4 lldetrimental to the public welfare or injurious to the property or ·ti I improvements in such vicinity and zone in which the property is 6l llocated because there is nothing about the sundeck that in itself 7 ll violates the Code or would affect in any way the public welfare. 8114. That the granting of such variance will not adversely affect 9 the comprehensive General Plan because although the pro~erty is 10 not currently in conformity with the Zoning Code, it is not felt 11 1 lthat this construction project will change the economic life of 121 lthe structure in any way. 13 NOW, THEREFORE, BE IT RESOLVED that in view of the above 14ll findings of fact, the Board of Zoning Adjustments of the City of 1511Hermosa Beach, California, does hereby grant the variance by the 161 lfollowing vote: 1711AYES: Comms, Berardo, Corder, Cutler, Williams, Chmn.
