HomeMy WebLinkAboutBZA 154-529 (964 15th St)1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 - 28 RESOLUTION B.Z.A. 154-529 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENT OF 'THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED AT 964 -15TH STREET (1429 & 1439 OCEAN DRIVE ON SAME LOT),HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on October 3, 1983, in the City Hall Council Chambers, considered the request of Mr. & Mrs. Charles Malamuth for permission to 1) add more than 40% to an existing dwelling with a nonconforming westerly sideyard of 2.2' and a nonconforming easterly sideyard of.0' in lieu of the 4.2' required and 2) structurally alter (addition) a nonconforming use (three units on an R-2 zoned property), on property legally described as Lot 16, Heffner-Fiorini-Allen TraGt; WHEREAS, at said public hearing, the following facts were presented for consideration: the property is located on in R-2 zone, low density residential; lot size is 42' X 135' and lot area is 5670 sq. ft., existing and proposed lot density is 23.04 du/ac, lot coverage is 35.6% and proposed lot coverage is 45.9%. The proposed addition is a bedroom and single garage attached to the single dwelling unit. The rear two units will not be altered and the proposed addition conforms to the setback requirements; WHEREAS, at said public hearing, the applicants were present to answer questionB; WHEREAS, at said public hearing, no one appeared to speak in opposition to the project; WHEREAS, after due consideration 1 it is the opinion of the Board ot Zoning Adjustments that the variance request is granted, for the following reasons: ?3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the building that is being modified is extremely old; the lot in question is very large; a parking unit is being added, and it is the parking unit which carries this project over the 40% expansion but the bedroom could be added without a variance. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone because the Board has granted many variances to allow people to expand their properties where necessary to more fully enjoy the potential buildings that could be erected on their property; any expansion of this building would require a variance. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because there is no significant change in the use of the property other than the continuation of three units. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because it will not adversely affect the General Plan beyond the already noted fact that this continues a three unit use in an R-2 zone. NOW, THEREFORE 1 BE IT RESOLVED that in view of the above findings of fact, the Board of Zoning Adjustments of the City of Hermosa Beach does hereby grant the variance by the following vote VOTE: AYES: NOES: ABSENT: Ill// Comms.
