RESOLUTION B.Z.A. 154-530 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 444 -31st STREET, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach at public hearing held on October 3, 1983, in the Council Chambers of the City Hall, considered the request of Mr. Greg Kelsey for permission to exceed the allowable lot coverage of 65% by 3.5% with a kitchen/dining nook extension, on property legally described as Lot 22, Block 125, Sahkespeare Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration: that the property is the in the R~l, medium density residential zone; that the lot area is 2100 sq. ft.; that the existing lot coverage is 64.5% and proposed is 68.5%; that the existing square footage is 2149 sq. ft.; and the proposed sq. footage is 47.5 sq. ft. and that a previous variance was granted for this property in February of 1979; and WHEREAS, at said public hearing the applicant stated that after having a child, the previous variance request was too small and that he wished to have a breakfast nook; and WHEREAS, at said public hearing it was noted that by extending the kitchen five feet, it will not change the building $tructurally; and WHEREAS, after due consideration, it is, the opinion of the Board of Zoning Adjustments that the request is minor in nature and justified for the following reasons: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved because this project was originally reviewed in 1979 to be inadequate in kitchen area and there is no solution to restructuring that area that is all practical without making use of this extra lot coverage; the exceptional circumstance is that it is the construction problem presented in straightening out an important internal problem, that being, a small kitchen. 2. The granting of this variance will not be materially detrimental to the pubJ,ic welfare or injurious to the property or improvemets in the vicinity and zone in which the property is located because others have been permitted to expand their properties through the use of variances required. 3. Thii;; variance is necessary fort preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone because this is an extremely minor change in the design of the structure and will not affect any of ihe various public welfare concerns in any significant way. 4. The granting of this variance will not adversely affect the comprehenpive General Plan because it does not affect the use of the property. .. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comrns. Berardo, Corder, Cutler, Williams, Chmn.
