A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE
CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY
LOCATED AT 1001 FOURTH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa
Beach, at a public hearing held on October 17, 1983 in the Council
Chambers of theCity Hall, considered the request of Kent and Lauren
Burton for permission to add over 40% to an existing single family
residence and detached garage with a nonconforming rear yard of
2.95' in lieu of the 5' required and to maintain the 2.95' setback
with the addition of a second story in lieu of the 3' required
setback at upper levels, per sections 401[d) and 1309 of the zoning
code, on property legally described as Lots 21 & 22 of Hopkins ·
Subdivision of Lot 5, Block 86, Second Addition to Hermosa Beach
Tract; and
WHEREAS, the following facts were presented for consideration;
that the lot area was 4948 sq. ft., that the existing and proposed
density was 8.8 du/ac; that the exisitng 1ot coverage was 31%
and that the proposed was 35%; staff suggested that if the
variance is approved that a deed restriction be imposed; ·and
WHEREAS, at said public hearing the applicant's representative
stated that the applicants have used about the only feasible method
of extending ,theiT house without virtually doubling their lot
coverage; and
WHEREAS: at said public hearing no appeared to speak in opposition
of the variance; and
WHEREAS, after due consideration, it is the opinion of the Board
of Zoning Adjustments that the request is justified for the following
reasons, with the addition of a deed restriction limiting the use
to a single family residerice:
1. That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved because this
construction is :on top o.f existing substantial construction not
easily removed or modified involving both walls, foundations,
and grade changes; therefor~ a1variance would be required for
expansion of this-property.
2. That the variar..::e is necessary for the preservation and enjoyment o, a substantial property right posse~sed by other property in
the same vicinity and zone, and deriied to the property ±.n question
because a reas0n~ble expansion of the property cannot be carried
out without this-sideyard variance; reasonable expansion of
property is a property right possessed by others in the same
vicinity and zone.

3.· That the granting of such variance will n~b be materially
detrimental to the public welfare or injurious to the
property or improvements in such vicinity and zone in which
the property is located because the variace encroaches only
minimally into required setbacks, and, given the large
lot size, would not substanually affect air circulation,
availability of light within the same vicinity and zone or
access to the property by public safety officers.
4. That the granting of. such variance does not adversely
affect the comprehensive General Plan because the use of the
property is not changed.
AND FURTHER, that the variance is granted subject to the following
condition:
That a deed restriction be recorded limiting the use of
the property to a single family residence.·
NOW, THEREFORE, BE TT RESOLVED, that in view of the above findings
of fact, the Board of Zoning Adjustments does hereby grant the
variance by the following vote: ·
