.. ., RESOLUTION B.Z.A. 154-534 ·'· lllA RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED 2 II AT 2918 STRAND, HERMOSA BEACH, CALIFORNIA. 3 WHEREAS, the Board of Zoning Adjustments of the City of 411 Hermosa Beach, at a public hearing held on November 7, 1983 in the 51 1City Hall Council Chambers, considered the request of Howard and 611Lynne Hartley for permission to add a second story to an existing 7 ll single family residence on property legally described as Lot 39, 8IIBlock 1, Shakespeare Tract; 9 WHEREAS, at said public hearing, the following facts lOl lwere presented for consideration: that the property is in the R-1 lll lzone, medium density residential; the lots is irregularly shaped 12 with a lot area of 3583 sq. ft. i existing lot coverage is 53.84% 13 and proposed lot coverage is 68.15%; and that the following 14llvariances are required: 1) add over 40% to a structure with non- 15 conforming yards as follows: a) rear yard -.5' in lieu of 3 1 16 required, b) south sideyard -1.5 1 in lieu of 3.2' required, and 17 c) north sideyard ~ ,3' in lieu of the 3.2 1 required; 2) maintain 18 the nonconforming northerly sideyard of .3' (first and second 19 story) and a nonconforming southerly sideyard of 2 1 (first story 20 only) with the addition; and 3) exceed the allowable lot coverage 21 ll of 65% by 3.15%; 22 WHEREAS, at said public hearing , the applicant's 23 representative stated that the proposal is to add 2,300 sq. ft. 24 to an existing house which is one story and a loft and too small 25 for the family of six; 26 WHEREAS, at said public hearing, no one appeared to 271 1speak in opposition to the project; 28 WHEREAS, after due considerationi it is the opinion of -· .... ? .-•-t'-.,.,, :.-r ../. ,< 1 the Board of Zoning Adjustments that the variance request is 2 granted for the following reasons: 3 1. That there are exceptional or extraordinary circumstances or 4 conditions applicable to the property involved because this 5 building was built 40 to 50 years ago before the existing setbacks 6 for front and side yards laws were enacted. 7 2. That such variance is necessary for the preservation and 8 enjoyment of a substantial property right possessed by other 9 property tn the same vicinity and zone because it is a right 10 enjoyed by other property owners that have had exceeded the 65% 11 lot coverage due to balconies only and not merely to the major 12 part of the building itself. 13 3. That the granting of such variance will not be materially 14 detrimental to the public welfare or injurious to the property or 15 improvements in such vicinity and zone in which the property is 16 located because it has n© affect on light, air, and open space and 17 has access to fire and safety personnel, 18 4, That the granting of such variance will not adversely affect 19 the comprehensive General '.Plan l:)ecause it i 's the same use of the 20 property in an R-1 area, 21 NOW, TllE'R,E;FORE, BE ;I;T RESOLVED that in view of the above 22 findings of fact, the Boa,rd of Zoning Adjustments of the City of 23 Hermosa Beach, California , does hereby grant the variance by the 24 following vote: 25 AYES: Comms.
