A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
1800 THE STRAND, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach
at a public hearing held on November 21, 1983, in the Council Chambers
of the City Hall, considered the request of Charles Sheldon for
permission to exceed the allowable lot coverage of 65% by 4.95% and
to encroach into the required sideyard and frontyard to the property
line with a stairway which is over 4' in height, not of concrete
and does not retrun to grade, on property legally described as
Lot 1, Block 19, Hermosa Beach Tract; and
WHEREAS, at said public hearing, the following facts were presented
for consideration; that the structure exceeds the allowable lot
coverage by overhanging portion of the building; that stairways may
encroach into the required sideyard if they are not over 4' in
height, constructed of concrete and return to grade; that the stair-
way varies from 3' in height to 6' and is not constructed of concrete;
that the nonconforming section is approximately 4.5 sq. ft.; and
that since the stairway is surrounded by public spaces it's not
returning to grade does not create an access problem nor does it's
combustible construction create a fire hazard; and
WHEREAS, at said public hearing the applicant stated that the lot
is shorter than many on the street; that it is 30 1 x 80' as opposed
to 30' x 90' and 30' x 95' and that in order to justify the land
costs and square footage required in the house, it was necessary
to have some decking in order to enjoy some private space; and
WHEREAS, at said public hearing no one appeared to speak in oppostion
to the variance; and
WHEREAS, after due consideration, it is the opinion ot the Board
of Zoning Adjustments that the variance request is justified for
the following reasons:
1. There are exceptional or extraordinary circumstances or
conditions applicable to property involved because (a) the
location is unusual in that it is surrounded on three sides
by public open space; (b) the 6% increase in lot coverage
is for decking only, open above and below, and not for enclosed
structure; (c) allowing this variance would convert the potential
use of the property from two units to a single family residence,
thus decreasing potential density; (d) the applicant is willing
to install and maintain landscaping in the City right-of-way
adjacent to the site.
2. The granting of this variance will not be materially detrimental
to the public welfare or injurious to the property or
improvements in the vicinity and zone because of the unique
circumstances (the surrounding public open space) and the
additional lot coverage does not violate any side, rear, or front
yard setbacks. Additionally, the owners of adjacent and neigh-
boring properties are in favor of granting the variance, as
indicated by their signatures on the petition.

3. This variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property
in the same vicinity and zone because similar variances have
been granted in the recent past in the same vicinity and zone.
4. The granting of this variance will not adversely affect the
comprehensive General Plan because the property will
represent a less dense development than would be allowed
by the zoning code.
5. That existing structure is in substantial violation of
current building codes (structure in setbacks and on city
property) and its removal will have a positive impact on the
neighborhood. ·
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings
of fact, the Board of Zoning Adjustments does hereby grant the
variance by the following vote; ·
AYES: Comms. Berardo, Corder, Chmn. Moore
NOES: None
ABSENT: Comms. Cutler, Williams
