A RESOLUTION OF THE BOJI_RD OF ZONING ADJUSTMENTS OF THE
CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY
LOCATED AT 245 -28th STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa
Beach at a public hearing held on December 5, 1983, in the Coucil
Chambers of the City Hall, considered the request of Mr. and Mrs.
Robin Radford for permission to expand the second story while
maintaining a nonconforming westerly sideyard which varies from
2.4' to 2.5' in lieu of the 3' required, on property legally
described as Lot 15, Block 114, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented
for consideration: that the property is located in the R-2
zone, medium density residential; that the lot area is 2400 sq. ft.;
existing lot coverage is 52% and proposed lot coverage is 52%;
that the sq. footage of the addition is 168 sq. ft.; that the
present second story is actually an occupied attic with sloping
ceilings formed by the roof; that the applicant proposes adding
dormers in five places which results in an increase of 168 sq. ft.
of usuable floor area; and that the dormers comprise 19.3' of
the 37 length of the building; and
WHEREAS, at said public hearing no one appeared to speak in opposition
to the variance; and
WHEREAS, after due consideration, it is the opinion of the Board
of Zoning Adjustments that the variance request is justified for
the following reasons:
1. There are exceptional or extraordinary circumstances or conditions
applicable to property involved because the sideyard encroachment
on this building predates the zoning code and was apparently
legal at the time of construction; therefore, any significant
remodel of the building, other than tearing it down and starting
from scratch, would require a variance.
2 . The granting of this variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in the vicinity and zone because withciut a variance this property
could not be expanded in the way that many other properties
in the same vicinity and zone have been expanded.
3 . This variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in
the same vicinity and zone because the mere modification of the
second story does not in any way downgrade the access to public
safety officers or light and air circulation in the area or in
any other way that would be detrimental to the vicinity.
4. The granting of this variance will not adversely affect the
comprehensive General Plan because the use of the property
does not change and is currently in line with the general plan.

NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings
of fact, the Board of Zoning Adjustments does hereby grant the
variance by the following vote:
AYES: Comms. Corder, Cutler, Williams, Chmn, Moore
NOES: None
ABSENT: Comm. Berardo

I hereby certify that the foregoing Resolution BZA 154-539 was
adopted by the Board of Zoning Adjsutments of the City of
Hermosa Beach at a regular meeting held on the 5th day of
December, 1983.
