HomeMy WebLinkAboutBZA 154-541 (1900 The Strand)1 , ,, - 3 4 5 6 7 8 9 10 11 12 13 14 1'5 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION B.Z.A. 154-541 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED AT 1900 STRAND, HERMOSA BEACH, CALIFORNIA·. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on December 19, 1983, in the C6uncil Chambers of the City Hall, considered the request of Mr. & Mrs. James Gierlich for permission to exceed the allowable lot coverage of 65% by 1.63% on an existing single family residence, legally described as Lot 1, Block 20, Hermosa Beach Tract; WHEREAS, at said public hearing, the following facts were presented for consideration: that the applicants were previously granted a variance in 1981 to add over 40% to a dwelling with nonconforming yards which is presently under construction and now wish to extend the front of the building three (3) feet closer to the front property line. The addition complies with the setback requirements. WHEREAS, at said public hearing , the applicant's representative ·assumed that there was a 7½ foot setback, then discovered that it was a 5 foot setback and the the project would not affect the view of any other homes. He also presented a letter from the neighbors immediately north of the project; WHEREAS, at said public hearing , no one appear in opposition to the project; WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1) That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the Board ~ 1 ,, 3 4 5 6 7 8 9 10 11 12 13 14 , ,. l::, 16 17 18 19 20 21 22 23 24 25 26 27 28 has granted similar variances in the same vicinity and zone. 2) That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone because the Board has granted similar variances in the same vicinity and zone. 3) That the granting of such variance Will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the project will not materially affect light or air circulation in the area, and the additional lot coverage of the structure will be within Code; parking will be increased from one to three spaces; no one appeared at the public hearing to speak in opposition. 4) That the granting of such variance will not adversely affect the comprehensive General Plan because the proposed use of the property is not changed by this project. NOW, THEREFORE, BE IT RESOLVED that in view of the above findings of fact, the Board of Zoning Adjustments of the City of Hermosa Beach, California, does hereby grant the variance by the following vote: AYES: NOES: ABSENT: Comms. Moore CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-541 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach, California, at a regular meeting held on the 19th day of December, 1983.
