A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 37 -
20TH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on July 6, 1981, in the Council Chambers of
the City Hall, considered the request of Mr. and Mrs. Michael Riedel
for permission to increase lot coverage from 65.9% to 66.63%; and to
add more than 40% to an existing structure while maintaining a non-
conforming sideyard of less than 3 ft., on property known as Lot 16,
Block 21, Hermosa Beach Tract.
WHEREAS, at said public hearing, the following facts were presented
for consideration; that there is a discrepancy between the recorded
lot dimensions and the submitted survey and, therefore, a record of
survey will be required prior to permit issuance; and
WHEREAS, at said public hearing, the applicants stated they are only
making a 53% addition, not an entire second floor and feel it will
be an asset to the neighborhood; and
WHEREAS, at said public hearing, a petition was submitted with 29
signatures of residents in favor of granting the request,.and one
person appeared at the meeting to speak in favor of approval; and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that, subject to conditions, the variance request
is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved because the house
was built in 1915 which predate existing code.
2. That such variance is necessary for the preservation and enjoy-
ment of a substantial property right possessed by other property
in the same vicinity and zone, and denied to the property in
question because this Board has granted many other variances
with the same conditions; the footprint is being changed fract-
ionally, which is only minor in nature; the same kind of var-
iances have been granted in the same vicinity and zone.
3. That the granting of such variance will not be materially detri-
mental to the public welfare or injurious to the:property or
improvements in such vicinity and zone in which the property is
located because there was a petition submitted with 29 signatures
in favor of granting the variance as well as one person appearing
to speak in favor of the variance; there will be at least three
feet between the buildings; the footprint is being changed only
fractionally; it will not substantially reduce the amount of
light, air, and open space; reduced incidence of fire will
still be provided with the separation between the buildings on
the westerly side.

4. That the granting of such variance will not adversely affect
the comprehensive General Plan because no one spoke in opposi-
tion at the public hearing; the General Plan is not affected
in that the number of units allowed by the General Plan and
Zone is lower; the dwelling unit attached to the garage will
be eliminated, thereby lowering the density.
AND, FURTHER, that the variance is granted subject to the following
condition:
1. That the second floor walls will be no closer than 1.5 1
from the property line.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning.Adjustments does hereby grant the variance
request by the following vote:
AYES: Comms. Merrill, Walker, Williams, Chmn. DeBellis
NOES: None
ABSENT: Comms. Ebey Moore, Toth
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-421 was adopted
by the Board of Zoning Adjustments of the City of Hermosa Beach at a
regular meeting held on the 6th day of July, 1981.
