HomeMy WebLinkAboutBZA Resolution 154-445 - (3125 The Strand),_ ,.1-\ RESOLUTION B.Z.A. 154-445 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 3125 STRAND, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on December 21, 1981 in the Council Chambers of the City Hall, considered the request of Mr. John Martin for permis- sion to (1) maintain a nonconforming north sideyard of 2.2' with a 465 sq. ft. addition; (2) to increase already nonconforming lot coverage of 71.89% to 77.49%; (3) to provide no usable open space at ground level that meets the minimum 10' dimension required; (4) to keep an existing second kitchen while converting a duplex into a single family residence; on property known as Lot 25, Block 1, Shakespeare Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that if the stairs and entrance to what is now the second unit were removed, it would reduce the proposed lot coverage to approx. 72% and would insure that the area being converted to part of the single dwelling unit could not be reconverted to .a duplex; that although there will be no usable open space at ground level that meets the minimum 10' dimension, there will be 180 sq. ft. at ground level remaining and 622.5 sq. ft. in decks; and WHEREAS, at said public hearing, the applicant's representative stated he had talked with the owner, who is out of the country at this time, and he is agreeable to removing the exterior stairway and entry to the current second unit; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the requests are justified, subject to condi- tions, for the following reasons: 1. That there are exceptional and extraordinary circumstances or condi- tions applicable to the property involved because the addition is minor in nature and the sideyard is only 8/10 of a foot less than required; the lot coverage is increasing less than 1%; there will be usable open space at ground level even though it does not meet : ,_ the minimum dimension of 10' ; the second kitchen is being allowed to remain with the removal of stairs and entry and with condition of a deed restriction to maintain property in R-1 use; they have usable open space of more than the required amount although not required dimension which should be adequate for the needs of the public. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because such variances have been granted to other properties in the same vicinity and zone in the past by the Board of Zoning Adjustments and the City Council. 3. That the granting of such variance will not be materially detri- mental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is -Continued - ., , ,-:\ PAGE 2 :;_ RESOLUTION B.Z.A. 154-445 3125 STRAND, HERMOSA BEACH located because none of the granted variances substantially reduce existing open space, light, air, access for fire safety~ and agreement to a deed restriction will decrease the congestion in that particular neighborhood in that it will be reduced from two units to one unit; they are increasing the parking from one space to two spaces. 1, That the granting of such variance will not adversely affect the comprehensive General Plan because the General Plan allows medium density residential, and the granting of these variances will ~estrict the use of the property to low density residential. AND, FURTHER, that this variance is granted subject to the following conditions: 1. That the stairs and entry to the present second unit be removed, thereby eliminating exterior access to the area. 2. That a deed restriction be recorded to maintain the prop- erty in R-1, single family use. NOW, THEREFORE, BE IT RESOLVED, that the Board of Zoning Adjustments of the City of Hermosa Beach does hereby grant the variance requests by the following vote: AYES: Comms. Cutler, Moore, Chmn. DeBellis NOES: Comm. Williams ABSENT: Comms.
