11 1 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, GRANTING· 'A VARIANCE ON PROPERTY LOCATED
2I IAT 2546 MANHATTAN AVENUE, HERMOSA BEACH, CALIFORNIA.
3 WHEREAS, the Board of Zoning Adjustments of the City of
4 Hermosa Beach, at a public hearing held on September 21, 1981, in
5 the City Hall Council Chambers, considered the request of
6 Mr. & Mrs. Pat Acuna for permission to add more than 40% to an
7 existing single family dwelling for property legally described as
8 11 Lot 6,and the northly 6 ft. of Lot 5, Block 66, 1st Addition to
9 11 Hermosa Beach Tract;
10 WHEREAS, at said public hearing, the following facts were
11 llpresented for consideration: that the property has a nonconformin
12 sideyard of 3 ft. in lieu of the 4 ft. 6 5/8 in required and the
13 owners wish to maintain the nonconformity with the addition. An
14 interior inspection has been made of the property and the existing
15 building is in conformance with the submitted plans;
16 WHEREAS, at said public hearing, the applicant was present
17 11 to answer quest ions;
18 WHEREAS, at said public hearing, no one appeared to speak
19 ll in opposition to the project;
20 WHEREAS, after due consideration, it is the opinion of the
21 Board of Zoning Adjustments that the variance request is granted
22 for the following reasons:
23 1.· That there are exceptional or extraordinary circumstances or
24 conditions applicable to the property involved because it predates
25 existing Code; the house was built in 1935; this type of variance
26 has customarily been granted by this Board and is in keeping with
27 the wishes of the City Council; the new addition will be built in
28 conformity with e x-:rsfing Code.

1112. That such variance is necessary for the preservation and
2 enjoyment of a substantial property right possessed by other
3 property in the same vicinity and zone because this variance has
4 11 the ability to build to the existing sideyard limit over the
5 11existing building and has been granted to other properties in the
6 I I same vicinity and zone in the past.
71 13. That the granting of such variance will not be materially
8 ll detrimental to the public welfare or injurious to the property or
9 11 improvements in such vicinity and zone in which the property is
10 1 I located because that area over the existing building will not
ll llsubstantially reduce light, air, open space, and the new construe~
12I ltion will conform to the existing code.
13 11 4. That the granting of such variance will not adversely a;f;fect
14 the comprehensive General Plan because it is preserttly zoned R-1 1
15 and the General Plan allows more; the applicant will agree to a
16 deed restriction maintaintng it lower than that allowed by the
17 General Plant
18 NOW, TJIEREFORE '.1 BE J:T ~ESOLVED that in ,view of the aooye
19 findings of fact 1 the Board of Zoning Adjustments of the City of
20 Bermosa Beach, Califo~nia, does hereby grant the variance by the
21 following ,vote?
