HomeMy WebLinkAboutBZA Resolution 154-439 - (1947 Manhattan Ave)_.,, RESOLUTION B.Z.A 154-439 l ll A RESOLUTiION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED 2 IIAT 1947 MANHATTAN AVENUE, HERMOSA BEACH, CALIFORNIA. 3 WHEREAS, the Board of Zoning Adjustments of the City of 41 1Hermosa Beach, at a public hearing held on November 16, 1981, in 5 11the City Hall Council Chambers, considered the request of Alice E. 6 11Villalobos for permission to add a two-car garage to the front of 71 1 their existing dwelling encroaching into the required front yard 8 I I setback to within 1 ft. of the property line and to within 2" of 9 11 the north side yard property line, on property legally described 10 as Lot 5, and So. 10' of Lot 6, Block 60, 1st Addition to Hermosa 11 Beach Tract; 12 WHEREAS, at said public hearing, the following facts 131 1were presented for consideration: that the topographic survey 14 11 shows an approximate 11 ft. slope from the front to the rear of 1511 the property, with an additional 6 ft. slope to Palm Drive; and 1611 that the base of the retainin-g wall which is 84.5 ft, is level 17llwith the stTeet; 18 WHEREAS, at said public hearing, the applicant stated 191/the need for the garage due to recent vandalization of her cars 20 and as a doctor ~or a pet clinic, she is on call 24 hours and 21 has to walk one or tw@ blocks at late hours; 22 WHE~EAS, at said public hearing, no one appeared to 2311speak in opposition to the project; 24 WHEREAS, after due consideration, it is the opinion of 2511 the Board of Zoning Adjustments that the variance request is 26 granted for the following reasons : 27 1. That there are exceptional o~-extraordinary circumstances or 28 il conditions applicable to the property involved because it is a ~-··) ~) .. 1 steep grade to the lot that would require substantial, expensive, 2 and risky excavation to place a garage in any other location other 3 than the proposed location; it prevents reasonable construction in 4 the front of the property is limited by the placement of the 5 existing structure on the property, and the structure has existed 6 over 50 years. 7 2. That such variance is necessary for the preservation and 8 enjoyment of a substantial property right possessed by other 9 property in the same vicinity and zone because on~site parking is 10 a substantial property right. 11 3. That the granting of such variance will not be materially 12 detrimental to the public welfare or injurious to the property 13 or improvements in such vicinity and zone in whic~ the property is 14 located because there is net gain of one parking spot; the 15 encroachments do not substantially reduce light, air, open space, 16 and access for fire. 17 4. That the granting of such variance will not adversely affect 18 the comprehensive General Plan because it maintains it an R-1 19 which is less than the General Plan designation. 20 AND, FURTHER, that the variance is granted subject to 21 the following: 22 That the proposed garage be moved at least 30 inches to 23 the south to provide the maximum possible north sideyard clearance 24 and that the garage be maintained as indicated. 25 NOW, THEREFORE, BE IT RESOLVED that in view of the above 26 findings of fact, the Board of Zoning Adjustments of the City of 27 Hermosa Beach, California, does hereby grant the variance by the 28 following vote: -2- .. ..
