A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH
GRANTING A VARIANCE ON PROPERTY LOCATED AT 2321 HERMOSA AVENUE, HERMOSA BEACH,
CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a
public hearing held on April 6th, 1981, in the Council Chambers of the City
Han, considered the request of Mr. Richard Saxon for permission to add more
than 40% to an existing single family dwelling, with nonconforming sideyards
and to maintain the nonconforming sideyards with the new addition, on property
legally described as Lot 11, Bleak 24, Hermosa Beach Tract; and
WHEREAS, at said public hearing, the following facts were presented for
consideration: that the southerly sideyard is 2' 611 ; that the northerly sideyard
is 21 811 ; that the new addition will be 111%; that Building Department inspection
revealed existing dwelling to be in conformance with plans submitted; that the
existing single family residence is very small and the request be granted
subject to a deed restriction; and
WHEREAS, at said public hearing, the applicant asked the Board 1f there was
sufficient potential to ask for a deed restriction, he would prefer not to have
such a restriction; and
WHEREAS, at said public hearing, the applicant~s representative stated that
there is virtually no way to divide the structure into apartments without closing
off complete access to the first floor bedroom, bathroom and stairway; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning
Adjustments that the variance is justified, subject to conditions, for the
following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the request is similar to
other side yard setback approvals, the building pre-dates 1944 and there
is no change in the footprint of the building.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because many other properties
in the same vicinity and zone exist in relatively minor nonconformity with
sideyard clearances and many properties in the same vicinity and zone have
been permitted upward extensions of that variance.
3. That the granting of such variance willnot be materially detrimental to
the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located because that reasonable
fire and safety access is not impeded by the project because the ground
floor clearance.-is not affected.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because the use of the property is maintained as a
single family residence in the R-3 zone with a deed restriction.

AND, FURTHER that this request is subject to following condition:
1. A deed restriction to be executed limiting the use of the
property to a single family residence.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance request
by the following vote:

CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-408 was adopted
by the Board of Zoning Adjustments at a regular meeting held on the 6th
