RESOLUTION B.Z.A. 154-430
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 553 -
TWENTY FOURTH PLACE, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at
a public hearing held on October 5, 1981 in the Council Chambers of the City
Hall, considered the request of Mr. and Mrs. Edward Beeles to add more than
40% to and existing single family residence with nonconfonning sideya-rds and
to maintain the nonconformity with the new addition and to exceed the
allowable height limit of 25 1 by 4 1 , on property legally described as Lot 4,
Block 2, Hermosa Park Tract; and
WHEREAS, at said public hearing, the following facts were presented for
consideration; that the applicants are requesting a two-part variance as
follows: to add more than 40% (second story) to an existing single family
dwelling with a nonconforming 2 1 611 westerly sideyard and a 3121
' easterly
sideyard in lieu of the 51 required in the R-1 zone, and to maintain the same
setbacl('for the addition, and to exceed the allowable height limit of 25 1 by
an additional 41 on the westerly side of the building; and
WHEREAS, at said public hearing, the applicant stated that he designed the
second story structure on the existing floor plan, and there was no feasible
roof line that would please the rest of the neighbors. He stated that due to
the severity of the slope, he felt he was not breaking the 25 1 height limit; and
WHEREAS, at said public hearing, a neighbor spoke in favor of the variance.
He stated that a remodel would help the area, he added he would not like the
look of a flat roof; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning
Adjustments that the variance is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because, as to the setback variance,
the house was built in 1927 and predates existing Code as to the side-
yard requirements; these kinds of variances have been customarily granted
by this Board and City Council; it maintians the same footprint; as to the
height variance, the slope of the lot could cause the addition to exceed
the height limit on the westerly side; the original structure was built
very high on the lot causing an unusually large crawl space on the westerly
side; this particular design permits an unusually large amount of open space
on the side fronted by the 29-foot wall, causing a minimum problem with
light and air circulation; the building design reflects a reasonable
effort to minimize the height of the two-story building; the largest partoof
the encroachment occurs in less than 25% of the length of the house.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in· the same vicinity
and zone, and denied to the property in question becuase the sideyard variance
has i:â–¡stomardly been granted in the past in the same vicinity and zone;
there has been height variances granted in the past on new construction.

3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvemnts in such
vicinity and zone in which the property is located because it does not
substantially reduce light, air or open space or access for public safety;
seven persons wither spoke or signed a petition in favor of granting
the variances; no one spoke in opposition to granting these variances.
4. That the granting of such variance will not adversely affect the com-
prehensive General Plan because it maintains low density.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance request
by the following vote:
