HomeMy WebLinkAboutBZA Resolution 154-440 - (1737 Valley Park Ave)RESOLUTION B.Z.A. 154-440 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1737 VALLEY PARK AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on December 21, 1981 in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. Greg Surowski for permission to add more than 40% to an existing single family dwel- ling with nonconforming north sideyard of 3 ft. (at carport) in lieu of the 4.5' required, and to enclose the carport into a garage main- taining the same nonconformity; also to encroach a bay window to within 3 ft. of the southerly sideyard property line and 2 ft. into the required 10 ft. front setback; and WHEREAS, at said public hearing, the following facts were presented for consideration, that the property is located in the R-1 zone, low density residential, the lot size is approximately .184.55 x 45.30, the existing and proposed lot density is 5.24 du/ac, the proposed lot coverage is 18.13%, for proposed addition is 941.5 sq. ft.; and WHEREAS, at said public hearing, the applicants stated that presently . they are able to get two cars into the carport, that they cannot build in the back of the house because there is an easement to for a sewer line running underneath the property, if they have to move the garage in from the side to meet code, it will not be wide enough to park a car; ~d WHEREAS, at said public hearing, a petition was submitted with the sig- natures of the neighbors on either side of the property as well as the neighbor across the street supporting the request; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zon- ing Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or condi- tions applicable to the property involved because the applicants are building a garage by enclosing an existing structure; that a City ease- ment in the large rear yard makes it impossible to provide alternate parking; the bay window projection is necessary for the architectural integrity of this particular project and is a very minor extension at a level at least four feet above the groun d . 2. That such variance is necessary f or the preservation and enjoyment of a substantial property right possessed by o ther property i n the same vicinity and zone, and denied to the p roperty in question becau se o ther properties in the same vicinity and z one have b een able to add s pace and provide covered parking. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it does not encroach upon the three-foot limit of sideyards defined as desirable -Continued - • i-- -1 PAGE 2 -RESOLUTION B.Z.A. 154-440 1737 VALLEY PARK AVENUE for fire and police access; it would not substantially reduce light and air circulation. 4. That the granting of such variance will not adversely affect the comprehensive General Plan because it does not change the use. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findirrgs of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Cutler, Moore, Chmn. DeBellis NOES: Comm. Williams ABSENT: Comms. Ebey, Merrill, Toth CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-440 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 21st day of December, 1981.
