HomeMy WebLinkAboutBZA Resolution 154-399 - (2432 Myrtle Ave)I I.., ' ... 1 2 3 RESOLUTION B.Z.A. 154-399 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED AT 2432 MYRTLE AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of 4 Hermosa Beach, at a public hearing held on March 2, 1981, in the 5 Council Chambers of the City Hall, considered the request of 6 Mr & Mrs. John Dunbabin for permission to encroach 3 1 into the 7 required front yard setback of 5' and to match an existing 2.6' 8 sideyard with a loft extension to the living room in lieu of the 9 3' required, on property legally described as Lot 47, Tract 820; 10 11 and 11 WHEREAS, at said public hearing, the following facts 12 were presented for consideration: that the previous owners had 13 agreed to abate an illegal unit by creating an interior stairway 14 converting the building to one unit and sign a deed restriction; 15 thd that Staff recommends that the deed restriciton be re-written 16 17 in the name of the applicants; and WHEREAS, at said public hearing it was expressed that 18 the deed rest~~ction also include that no further encroachment 19 would be permitted, such as enclosing the deck; and 20 21 22 WHEREAS, at said public hearing the applicant agreed to said deed restriction; and WHEREAS, after due consideration, it is the opinion of 23 the Board of Zoning Adjustments that the variance be granted for 24 the following reasons: 25 1. That ther are exceptional or extraordinary circumstances or 26 conditions applicable to the property involved because the buildin 27 is 50 years old, predating the current City Code; and that this 28 is a logical place to put the stairway. qd-3 1 11 2. That such variance is necessary for the preserv ation and 2 enjoyment of a substantial property right possessed by other 3 property in the same vicinity and zone because the granting of 4 11 the variance will enhance the property to maintain it as a single 5 family residence; and the other property owners in the area would 6 like to see the property converted back to a single family ,res·iden¢e. 7 3. That the granting of such variance will not be materially 8 detrimental to the public welfare or injurious to the property 9 or improvements in such vicinity and zone because the grant :i,ng 10 of the front yard variance does not substantially reduce the 11 amount of light, air or open space, or increase the incidence of 12 fire ; there was no objection form the neighboring properties at 13 the public hearing. 14 4. That the granting of such variance will not adversely affect 15 the comprehensive General Plan because it will, with the addition 16 of a deed restriction maintain lthe property in a use that is 17 consistent •±th the general plan designation. 18 NOW , THEREFORE , BE TT RESOLVED that in view of the above 19 findigns of fact, the Board of Zoning Adjustments of the City of 20 Hermosa Beach, California does hereby grant the variance by the 21 following vote : 22 23 11 AYES: Comm, Ebey, Merrill , Moore, Williams , Chmn, DeBellis NOES : None 24 ABSENT; Comm Walker 25 /Ill/ 26 /Ill 27 Ill/ 28 Ill/ 1 11 CERTIFICATION 2 I hereby certify that the foregoing Resolution B.Z.A. 154-399 3 was adopted by the Board of Zoning Adjustments of the City of 4 11 Hermosa Beach, California, at a regular meeting held of the 5 11 2nd day of March, 1981. 6 7 8 911 DATE 10 11 12 13 14 ~::: CarlC;P{Ef!!ry 17 18 19 20 21 22 23 24 25 26 27 28 'i ;)l~~ Tony D~is, Chairman
