( RESOLUTION B.Z.A. 154-420 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 843 EIGHTH PLACE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on July 6, 1981, in the Council Chambers of the City Hall, considered the request of Mr. and Mrs. James Bates for permission to build an attached garage to within 3 ft. of the westerly property line in lieu of the required 5 ft., thereby adding more than 40% to an existing single family dwelling with a noncon- forming 4 ft. east sideyard, on property known as Lot 52, Tract 8386; ~d WHEREAS, at said public hearing, the following facts were presented for consideration; that there was an earlier variance granted on this property that included the subject request but the approval expired in 1979; and WHEREAS, at said public hearing, the applicant stated that the exist- ing single car garage is located on the rear and side property line and is in poor condition; and WHEREAS, at said public hearing, no one appeared to speak in opposi- tion to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because the house was built in 1927 which predates existing Code; this type of variance has been customarily granted in the past; the remaining three feet on the westerly sideyard will not be a hindrance to fire access; there is a steep slope on the easterly side which would cause a hardship to not grant the continuance of the 4 ft. east sideyard. 2. That such variance is necessary for the preservation and enjoy- ment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because other property in the same vicinity and zone has been granted the same variance. 3. That the granting of such variance will not be materially detri- mental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because it will increase the off-street parking by one space; there will still be three feet remaining on the westerly sideyard which provides more than adequate access for fire; it is more than the existing garage at the property in the rear; there were no letters submitted in opposition to the request, and no one appeared to speak in opposition to the granting of the variance; it does not substantially reduce light, air, open space. -Continued - ,.. ~ ('~ \ i PAGE 2 -RESOLUTION B.Z.A. 154-420 843 EIGHTH PLACE 4. That the granting of such variance will not adversely affect the comprehensive General Plan because it will maintain the property in the use allowed by the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Merrill, Walker, Williams, Chmn. DeBellis NOES: None ABSENT: Comms. Ebey, Moore, Toth CERTIFICATION I hereby certify that the foregoing Resolution BZA 154-420 was adopted by the Board of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the 6th day of July, 1981.
