RESOLUTION B.Z.A. 154-417
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
433 -31ST STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on June 15, 1981, in the Council Chambers of
the City Hall, considered the request of Mr. and Mrs. Richard M.
Loeffler for permission to: 1) Add a second story to an existing
single family dwelling with nonconforming west sideyard of 2.87', an
east sideyard of 2.95' in lieu of the 3' required, and with a non-
conforming front setback of 4.3' in lieu of the 7' required; also
to maintain the nonconformity with the addition; 2) To add a first
floor deck and second story balcony encroaching to front property
line; 3) To add square footage to an existing building with noncon-
forming parking depth of 16' in lieu of the 18' required; on property
known as Lot 17, Block 124, Shakespeare Tract; and
WHEREAS, at said public hearing, the applicant stated they have
always utilized their off-street parking at the rear of the build-
ing and would continue to do so; that they would be removing an
existing deck located at the rear and west side property line; and
WHEREAS, at said public hearing, two petitions in favor of granting
the variance were submitted, one with 6 names and one with 3 names;
and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the variance request is justified for the
following reasons:
1. That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved because the build-
ing was built in 1941 which predates existing Code, and this type
of variance has customarily been granted by this Board, and it is
in keeping with the intent of the City Council of Hermosa Beach.
2. That such variance is necessary for the preservation and enjoy-
ment of a substantial property right possessed by other property
in the same vicinity and zone, and denied to the property in
question because other property in this immediate vicinity has
been given similar variances in the recent past under similar
conditions and, in order to meet the parking requirement for
request No. 3 the applicant will be required to tear down the
rear wall of his structure, which is an unreasonable hardship.
3. That the granting of such varia_nce will not be materially detri-
mental to the public welfare or injurious to the property or
improvements in such vicinity and zone in which the property is
located because the variances granted will not substantially
reduce light, air, open space, nor increase the incidence pos-
sibility of fire. There were no persons to speak in opposition
to this request, and nine persons who were immediate property
owners submitted petitions in favor of granting the variance.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because it does not change the dwel-
ling units per acre allowed by the General Plan.

NOW, THEREFORE, BE IT RESOLVED that in view of the above findings of
fact the Board of Zoning Adjustments does hereby grant the variance
request by the following vote:
AYES: Comms. Ebey, Merrill, Toth, Walker, Williams, Chmn. DeBellis
NOES: None
ABSENT: Comm. Moore
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-417 was adopted
by the Board of Zoning Adjustments of the City _of Hermosa Beach at a
regular meeting held on the 15th day of Jurie, 1981.
