RESOLUTION B.Z.A. 154-427
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF .UERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
1135 SIXTH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on August 17, 1981 in the Council Chambers of
the City Hall, considered the request of Barbara and John Fugatt for
permission to add more than 40% to an existing single family dwelling
with a nonconforming 2'4" easterly sideyard in lieu of the 3'6" required,
and to meet current code with the new addition; and
WHEREAS, at said public hearing, the following facts were presented for
consideration; that the existing storage area on the lower floor plan
had been a bootleg unit that was abated by the present owners when they
purchased the property; that this area did not meet minimum ceiling
height or light and ventilation to be used as living area; and
WHEREAS, at said public hearing, the applicant stated he would prefer
to add three additional parking spaces rather than sign a deed restrict-
ion limiting the property to single family usage; and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zon-
ing Adjustments that the variance request is justified, subject to con-
ditions, for the following reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the building was
built in 1933 which predates existing Code; this type of variance
has been customarily granted by this Board, and it is in keeping
with the intent of the City Council of Hermosa Beach to preserve
existing housing stock.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to th~ property in question
because this Board has customarily granted variances of this nature
in the same vicinity and zone, and this applicant has agreed to pro-
vide three additional parking spaces.
3. That the granting of such variance will not be materially detri-
mental to the public welfare or injurious to the property or
improvements in such .vicinity and zone in which the property is
located because the variance granted will not substantially reduce
light, air, open space, nor increase the incidence possibility of
fire; there were no persons to speak in opposition to this request
at the public hearing.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because there is no change in the number
of units allowed on the lot.
AND, FURTHER, that this variance is granted subject to the following

1. That the applicant will provide three additional parking spaces to
meet R-2 requirements.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Zoning Adjustments does

AYES: Comms. Merrill, Moore, Williams, Chmn. DeBellis
NOES: None
ABSENT: Comms. Ebey, Toth, Walker

I hereby certify that the foregoing Resolution BZA 154-427 was adopted
by the Board of Zoning Adjustments of the City of Hermosa Beach at a
regular meeting held on the 17th day of August, 1981.
