A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 218
EIGHTH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on October 5, 1981 in the Council Chambers of
the City Hall, considered the request of Mr. Michael Updike for permis-
sion to add more than 40% to an existing single family dwelling with
nonconforming yards and to maintain the nonconforming setbacks with the
new addition; also the existing garage falls short of the minimum gar-
age depth of 28' by approximately 6"; and
WHEREAS, at said public hearing, the applicant stated that the garage
foundation is approximately 2' above grade and in order to get the
additional 2 inches in depth, he would have to rebuild the entire founda-
tion,·om his garage; and
WHEREAS, at said public hearing, a petition was submitted sighed by
two neighbors in favor of the request and no one appeared to speak in
opposition; and
WHEREAS, after due consideration, it is the opinion of the Board of Zon-
ing Adjustments that the variance request is justified with the condi-
tion that the door style of the garage be changed to allow maximum
utilization of the area, for the following reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the building is
so recent with the nonconforming sideyard which suggests that prob-
ably some City approvals had been given; the house is on one of the
smaller lots in the area, and the plans show an attractive and
creative way of making a livable-sized house on a very small area;
the most significant encroachment stems from 1922 and predate exist-
ing code.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to the property in question
because the nonconformities will not be made any greater, but it
will make a more livable-sized house out of the existing noncon-
formities which were granted to him in the recent past; there have
been similar variances granted in the same vicinity and zone.
3. That the granting of such variance will not be materially detri-
mental to the public welfare or injurious to the property or improve-
ments in such vicinity and zone in which the property is located
because it does not reduce light, air, open space or access for
safety personnel; it does not add to the existing footprint; two
of the encroachments are on a corner which has no adjoining prop-
erty; the immediate neighbors signed a petition in favor of grant-
ing the variance; no one spoke in opposition at the public meeting.
4. The granting of such variance will not adversely affect the compre-
hensive General Plan because there will be no increase in the num-
ber of dwelling units.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance by
the follow~ng vote:
AYES: Comms. Ebey, Moore, Toth, Walker, Williams, Chmn. DeBellis
NOES: None
ABSENT: Comm. Merrill
