HomeMy WebLinkAboutBZA Resolution 154-401 - (1346 Bayview Dr)~ , RESOLUTION B.Z.A. 154~401 1 11 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH , CALIFORNIA, DENYING A VARIANCE ON PROPERTY LOCATED 2 11 AT 1346 BAYVIEW DRIVE, HERMOSA BEACH, CALIFORNIA. 31 1 WHEREAS , the BoaTd of Zoning Adjustments of the City of 4 11 Hermosa Beach, California, at a public hearing held on March~. 5 111981, in the Council Chambers of the City Hall, considered the 611 request of Mr, Ralph Ruth~rford for permission to retain a wood 71 1 deck and st airs in the required northe:rly sideyard to property SIi line; legally described as SW 55' of Lot 32 , Block 49, 1st 911 Addition '.'ito Hermosa Beach Tract: 101 1 WHEREAS , at said public hearing, the following facts were 111 1 presented for consideration: that the wood deck and st airs in 1211 the required nortnerly-s;i;deyaTd were constructed without the 1311 required permits; the building exceeds the allowable lot coverage 1411 by 7% with the new stairs and deck; and this property is also 15 11 nonconforming as to use ., be:i,ng a 4-unit building on a lot that 1611 will only allow a single family residence under present code; 17 WHEREAS 1 at said public heaTing , the applicant said that 18 they moved the stairway to the prope:rty line in order to put 191 1 the trash receptacles under the stairs, in that they were an 2011 eyesore in their previous location. He said he was basically 2111 requesting permission to 'l'.'ep·lace the original balcony that was 221 1 to:rn down, in order to gi,ve access to the tenant of the unit , 23 WHERE~S, at said public hea:ring I no, Jone appeared in 24 opposition to the project ; 25 11 WHEREAS , after due cons;lderation , it is the opin;i,on of 2611 the Board o;f Zoning Adjus·tments that the variance request is 27 11 denied for ·the following reasons: 2811 1. That there are no exceptional or extraordinary circumstances 4-? ---r ---7 r , 1 1 11 dtt donditions applicable to the property. 21 12. That this property right is not possessed by other properties 3 11 in the same vicinity and zone. 4 113. That the granting of such variance could be detrimental to 5 ll the public welfare in that it exceeds lot coverage, four units 6l l on a lot large enough to allow one unit under the present Code; 7 11 could possibly increase the incidence of likelihood of injury 8 11 to neighboring property. 91 14, That the granting of such variance could adversely affect lO ll the comprehensive General Plan because it continues and ll llenhances a legal non-conforming use. 12 NOW, THEREFORE, BE IT RESOLVED that in view of the above 13l l findings of fact, the Board of Zoning Adjustments of the City of 1411Hermosa Beach, California, does hereby deny the variance by the 15 11 following vote: 1611 AYES: NOES: 17 I I ABSENT : Comms, Ebey, Merrill, Moore, Williams, Chmn.
