RESOLUTION B.Z.A. 154-444
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 2424
PALM DRIVE, HERMOSA BEACH, CALIFOARNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on December 21, 1981, in the Council Chambers
of the City Hall, considered the request of Mr. Larry Wicker for per-
mission to maintain a nonconforming south sideyard of 2.5 ft. with the
addition of a dining room, deck and stairs to an existing duplex being
converted to a single family residence, on property known as Lot 20,
Block 29, 1st Addition to Hermosa Beach Tract; and
WHEREAS, at said public hearing, the following facts were presented
for consideration; that the existing lot density is 32.26 du/ac and the
proposed lot density is 16.13 du/ac; that the existing lot coverage is
38.79% and the proposed is 44.66%; that the proposed addition is 274.25
sq. ft.; and
WHEREAS, at said public hearing, the applicant stated that the exten-
sion is very small bu~ wilh allow access between the floors; and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zon-
ing Adjustments that the request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the house was
built before 1925 which predates existing code; the request maintains
a nonconforming south sideyard which is only six inches short of the
required sideyard setback; the request is exceptionally minor in
nature and is in keeping with City Council wishes to preserve exist-
ing older residences in the City of Hermosa Beach.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to the property in question because
other properties in the same vicinity and zone have been granted sim-
ilar or greater variances; and it would be a substantial property
right denied to this property owner if not granted.
3. That the granting of such variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in such vicinity and zone in which the property is located because
it is not substantially reducing light, air, open space, or access
for fire and safety; the neighbor on the south side signed a peti-
tion in favor of granting the variance; and no one spoke in opposi-
tion to granting the variance.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because it will reduce the use of the
property to meet the General Plan.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance by
the following vote:
