RESOLUTION B.Z.A. 154-446
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 345 -
34TH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on December 21, 1981 in the Council Chambers
of the City Hall, considered the request of Mr. and Mrs. Michael Saign
for permission to add a partial second story to a single family resi-
dence (over the garage) that has a nonconforming 2'6" east sideyard
and to maintain the same nonconformity with the addition; on property
known as Lot 6, Block 122, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented for
consideration; that the lot density is 16.13 du/a, the existing lot
coverage is 47% and the proposed 54%; the proposed addition is 553 sq.ft.;
and
WHEREAS, at said public hearing, the applicant stated he is asking for
a six-inch variance and he believes this would not be detrimental to
the neighbors; and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zon-
ing Adjustments that the variance is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the property was
constructed in 1949 which predates existing Code for required side-
yard setbacks; it is six inches short of meeting the required three
foot setback, and the request is to maintain that in the same non-
conformity at the second story level; similar variances have been
granted by the Board.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to the property in question
because other properties in the same vicinity and zone have been
granted the same variance for the furtherance of preserving and
enhancing the housing stock of Hermosa Beach.
3. That the granting of such variance will not be materially detrimental
to the public welfare or injurious to the property or improvements
in the same vicinity and zone in which the property is located
because it does nto substantially reduce light, air, open space,
and access for fire safety.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because the General Plan and zoning both
allow more units than are presently on the property.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments of the City of Hermosa Beach does
hereby grant the variance request by the following vote:
