A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A CONDITIONAL USE PERMIT TO ALLOW
THE OPERATION OF A PRE-SCHOOL AND DAY CARE CENTER ON PROP-
ERTY LOCATED AT 417 -25TH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on August 17, 1981, in the Council Chambers
of the City Hall, considered the request of Carolyn and Ike Chazin
for permission to operate a pre-school and day care center on a
portion of North School, also known as Lots 10 through 17 and part
of Lots 18 and 19, Block 5, Hermosa Terrace Tract; and
WHEREAS, at said public hearing, the Board heard testimony from the
applicants that they will be occupying four rooms at North School;
that they will be licensed by the State for 100 to 120 children; that
the children will be dropped off prior to 8:00 a.m. and will be picked
up promptly at 6:00 p.m.; and that the playground will be available to
the public anytime after 6:00 p.m.; and
WHEREAS, at said public hearing, two residents of the area spoke in
opposition to the request and submitted a letter containing the signa-
tues of 36 people in the surrounding area who are opposed to the
projects; and
WHEREAS, the proposed conditional use permit is in conformance with
the area's zoning and general plan designation, and the use is not
unreasonably incompatible with the type of use in the surrounding
area;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Zoning Adjustments
of Hermosa Beach does hereby approve a conditional use permit to allow
the operation of a pre-school and day care center at 417 -25th Street,
subject to the following conditions:
1. Hours of operation to be 6:00 a.m. to 6:00 p.m.,Monday through
Friday.
2. A street-side monitor shall be provided during peak arrival and
departure hours, 7:00 to 8:30 a.m. and 5:00 to 6:00 p.m.
3. This conditional use permit is awarded on the condition that the
applicant will demonstrate due appreciation to the laws and
regulations of the agencies having jurisdiction over the school.
4. There shall be a 6 month review.
Applicant has signed a statement attached to his business license appli-
cation which reads: "The issuance of this business license is for rev-
enue purposes only and does not constitute a waiver on behalf of the
City to enforce any City ordinance which might be violated by the busi-
ness activity." Applicant's attention is directed to the Hermosa
. Beach City Code, especially the chapters on licensing, nuisances and
) signs. Willful and continuing violations of the City Code will con-
stitute grounds for a hearing to show why this permit should not be
revoked.
