RESOLUTION B.Z.A. 154-418
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF
HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 970
SIXTH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on July 6, 1981, in the Council Chambers of
the City Hall, considered the request of Mr. Charles Gee for permis-
sion to add more than 40% (143%) to an existing single family resi-
dence with a nonconforming east sideyard of 5.65' in lieu of the
required 6.38', and to continue the nonconformity with the second
story addition; and
WHEREAS, at said public hearing, the applicant stated he desires to
demolish the existing garage, construct a new garage attached to the
dwelling, and to add a second story on the building; that his vari-
ance request is so minor it is eligible for an administrative variance
but due to time constraints, he is going through the shorter process;
and
WHEREAS, at said public hearing, no one appeared to speak in opposi-
tion to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the variance request is justified for the
following reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because the residence
was constructed in 1939 which predates existing Code, which
requires a 6.38 ft. sideyard; the variance is minor in nature; it
has been customarily granted by the Board and is in keeping with
the wishes of the City Council.
2. That such variance is necessary for the preservation and enjoyment
of a substantial property right possessed by other property in the
same vicinity and zone, and denied to the property in question
because variances of this nature have been customarily granted in
the past in the same vicinity and zone.
3. That the granting of such variance will not be materially detri-
mental to the public welfare or injurious to the property or
improvements in such vicinity and zone in which the property is
located it will not substantially reduce the amount of light, air
and open space or increase the incidence for potential of fire
hazard.
4. That the granting of such variance will not adversely affect the
comprehensive General Plan because it has no effect on the number
of units allowed by the General Plan.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of
fact, the Board of Zoning Adjustments does hereby grant the variance
by the following vote:
AYES: Comms. Merrill, Walker, Williams, Chmn. DeBellis
NOES: None
ABSENT: Comms. Ebey, Moore, Toth
