A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT
2317 MANHATTAN AVENUE, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at public hearings held on July 6 and August 17, 1981, in the Council
Chambers of the City Hall, considered the request of Mr. and Mrs.
William Schneider for permission to encroach into their required
front yard setback to property line with a 6 ft. high fence on top
of a 1 ft. brick planter and with a 9 ft. high trellis, on property
known as Lots 12 and 13, Block 30, 1st Addition to Hermosa Beach
Tract; and
WHEREAS, at said public hearing, the following facts were presented
for consideration; that should the Board grant the request, it will
be necessary for the applicants to request an encroachment permit
from the City Council for the portion of the fence that is approxi-
mately 1½ ft. onto city property; and
WHEREAS, at said public hearings, the applicants stated they need
the fence for security reasons, due to five break-ins or attempted
break-ins within the last five years; that until the 1950's there
was a six-foot high chain link fence around the entire property; and
WHEREAS, at said public hearings, a petition with 20 signatures was
submitted favoring the request; and three anonymous letters were
received in opposition to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the granting of the variance is not justified
for the following reason:
1. That there are no exceptional or extraordinary circum-
stances or conditions applicable to the property
involved that do not apply to many other properties
in the area.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above finding of
fact, the Board of Zoning Adjustments does hereby deny the variance
request by the following vote:
AYES: Comms. Merrill, Moore, Williams, Chmn. DeBellis
NOES: None
ABSENT: Comms. Ebey, Toth, Walker
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-419 was adopted
by the Board of Zoning Adjustments of the City of Hermosa Beach at a
regular meeting held on the 17th day of August, 1981.
