RESOLUTION B.Z.A. 154-437
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT
321 -28TH STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on November 23, 1981 in the Council Chambers
of the City Hall, considered the request of Mr. and Mrs. Britt Johnson
for permission to add two bedrooms and a bath to an existing single
family dwelling which will increase the existing lot coverage of 65.57%
to 76% and will also reduce the existing usable open space from 250.75
sq. ft. to 166.50 sq. ft. (none at ground level), on property known
as Lot 27, Block 114, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented
for consideration; that the increase in lot coverage is due to the
proposed overhang of the second story also resulting in the reduction
of the usable open space; and
WHEREAS, at said public hearing, the applicant stated he has done an
"eyeball" survey of surrounding properties and he estimated that 35%
have more than 75% lot coverage; and
WHEREAS, at said public hearing, no one appeared to speak in opposi-
tion to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the variance request is not justified for the
following reasons:
1. That there are no exceptional or extraordinary circumstances
or conditions applicable to the property involved because there
is a lack of compelling construction problems, lot layouts, or
layout of the existing building.
2. There no compelling evidence was brought forward at the hear-
ing that this is a substantial property right possessed by other
property in the same vicinity and zone.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Zoning Adjustments
does hereby deny the variance by the following vote:
AYES: Comms. Merrill, Moore, Williams, Chmn. DeBellis
NOES: None
ABSENT: Comms. Ebey Toth
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-437 was adopted
by the Board of Zoning Adjustments at a regular meeting held on the
23rd day of November, 1981.
