A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 575 -20TH STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on November 8, 1980, in the Council Chambers of the City Hall, consid-
ered the request of Mr. John M. Miller for permission to add more than 40% to an
existing single family dwelling with nonconforming east sideyard and to continue
the nonconforming sideyard for the new addition, on property known as Lot 51 and
the west 12 ft. of Lot 50, Tract 1868; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the applicant propose to construct a 1,258 sq. ft. second floor plus a 238 sq. ft.
two-story entry, while maintaining a four foot sideyard in lieu of the five foot side-
yard required; and
WHEREAS, at said public hearing, one resident appeared to speak in opposition to the
request; and
WHEREAS, at said public hearing, the applicant stated he would agree to a deed
restriction limiting the use of the property to a single family dwelling; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the nonconforming sideyards are
existing.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity
and zone, and denied to the property in question because it is within the
R-1 zoning requirements to add a second story; and because various changes
in building and zoning codes created nonconforming sideyards as one of the
most common variances granted throughout the city.
3. That the granting of such variance will not be materially detrimental
to the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located because for residential
construction, the sideyards are adequate for passage of fire equipment.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because the proposed project is in compliance with the
General Plan.
AND, FURTHER, that the variance is -granted subject to the following condition:
1. That a deed restriction be recorded limiting the property to single
family usage.
NOW, THEREFORE, BE IT RESOLVED that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the request by the following vote:
AYES: Comms. Beard, DeBellis, Simpson, Chmn. Cummings
NOES: None
ABSENT: Convns. Ebey, Sims, Toth

I hereby certify that the foregoing Resolution BZA 154-300 was adopted by the Board
of Zoning Adjustments at a regular meeting held on the 8th day of November, 1978.
