A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 2460 MYRTLE AVENUE,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on October 2, 1979, in the Council Chambers of the City Hall, considered
the request of Mr. and Mrs. Steven Peterson for permission to add more than 40% to
an existing single family dwelling which is nonconforming as to yards; also, there
are existing stairs of wood construction exceeding 4 feet high in the north sideyard,
on property known as Lot 55, Tract 820; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that, although zoned R-2, the lots in this area are limited to R-1 use due to parking
requirements, because tandem parking is not allowed on the street; that a survey which
locates the building on the lot will be required before a building permit is issued;
and
WHEREAS, at said public hearing, the applicant stated that the sideyard application
is an insurance due to the inability to get a survey before the public hearing; that
he is not sure he will need that part of the variance once a survey is made; that the
preliminary request was due to the existing stairway not meeting current codes and
could not be altered to meet current codes; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the request,
but one letter was received opposing the request due to view blockage; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved because there is no other way to add to this house without
substantial demolition of the existing structure. The variance is minor in nature
and a technicality.
2. That such variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone, and denied
to the property in question because many other owners in the vicinity are in the same
position because of topography.
3. That the granting of such variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in such vicinity and zone in which
the property is located because the stairway in and of itself has not effect on the
surrounding properties.
4. That the granting of such variance will not adversely affect the comprehensive
General Plan because the number of dwelling units per acre has not increased and this
property is in conformity with the General Plan.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Comms. Beard, DeBellis, Ebey, Simpson, Sims, Toth, Chmn. Cummings
NOES: None
ABSENT: None

I hereby certify that the foregoing Resolution BZA 154-293 was adopted by the Board
of Zoning Adjustments at a regular meeting held on the 2nd day of October, 1978.
