HomeMy WebLinkAboutBZA Resolution 154-306 - (137 Hermosa Ave)RESOLUTION B.Z.A. 154-306 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A CONDITIONAL USE PERMIT FOR OUTSIDE SERVICE OF FOOD ON PROPERTY LOCATED AT 137 HERMOSA AVENUE, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on January 10, 1979, in the Council Chambers of the City Hall, consid- ered the request of Mr. Stephen Nauert to allow the outside service of food in a proposed patio area of an existing restaurant, on property known as lot 8, Block 2, Hennosa Beach Tract; and WHEREAS, at said public hearing, the commission heard testimony from the applicant that the use of the patio would be dependent upon the weather; that there is no provision for lights for use of the patio at night; that food would not be sold "to go" and the handout window will be discontinued; that he would be willing to comply with whatever trash bin location the city could approve; and WHEREAS, at said public hearing, two residents spoke in opposition to the request, expressing concern with trash problems existing at that location; and WHEREAS, after due consideration, the Board found the proposed usage to be consis- tent with the zoning and the General Plan for the area; NOW, THEREFORE, BE IT RESOLVED, that the Board of Zoning Adjustments of the City of Hermosa Beach does hereby approve a conditional use permit for outside service of food at an existing restaurant subject to the following conditions: VOTE: 1. That all food service be confined to private property and does not infringe upon the public right-of-way. 2. Hours of the patio shall not exceed 9:00 p.m. each evening. 3. Operators will be responsible for maintaining the area in a neat and clean condition and insure that litter will not spill onto the public right-of-way. 4. The trash bin shall be enclosed, in some way confined within the property, not exposed or on public property, and kept in a neat and attractive manner. 5. That this permit is subject to a six month review. AYES: Comrns. Beard, DeBellis, Ebey, Simpson, Chmn. Toth NOES: None ABSENT: Comms.
