HomeMy WebLinkAboutBZA Resolution 154-314 - (1710 Loma Dr)RESOLUTION B.Z.A. 154-314 1 II A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS ' OF THE CITY OF II HERMOSA BEACH, CALIFORNIA, APPROVING A VARIANCE ON PROPERTY LOCATE 2 AT 1710 LOMA DRIVE, HERMOSA BEACH, CALIFORNIA. 3 4 WHEREAS, the Board of Zoning Adjustments of the City of 5 Hermosa Be·ach, at a public hearing held on February 5, 1979, in th 6 City Hall Council Chambers, considered the request of John and Loi 711Peek for permission to add more than 40% (212% pToposed) to an 8l lexisting structure with nonconforming 2,4 ft, south sideyard for g 1~roperty legally described as Lot 3, Tract 2649; 10 WHEREAS, at said public hearing, the following facts 11 were presented for consideration: that the property is in an R-3 12 zone with a general plan designation of medium density residential~ 13 and existing lot coverage is 51% and proposed lot coverage is 64%; 14 WHEREAS, at said public hearing, the applicant's 15 representative stated that everything that •is .now proposed ·will 16 conform to code and that they would have no objections to the 17 Board restricting the property by a deed restr;:i,ct;lon which would 18 limit the use of the property to single family usage and that off~ 19 street parking be maintainedj 20 WHEREAS~ at said public hearing, no one appeared to 211 1speak in opposition to the project; 22 WHEREAS, after due consideration, it is the opinion of 23 the Board of Zoning Adjustments that the variance is granted, for 24 the following reasons: 25 1, That th,ere are exceptional or extraordinary circumstances or 26 conditions applicable to the property invo~ved because the project 27 comes within the scope of the type the Board has previously found 28 exceptional . -· 1 11 2. That such variance is necessary for the preservation and 2 il enjoyment of a substantial property right possessed by other 3 ll property in the same vicinity and zone because without this 4 1 lvariance, this remodel could not be performed. 51 13. That the granting of such variance will hot be materially 6 ll detrimental to the public welfare or injurious to the property or 7 11 improvements in such vicinity and zone in which the property is 8lllocated because the new construction will not encroach and the 9 ll applicant has agreed to a deed restriction, 10 11 4. That the granting of such variance will not adversely affect 11 1 lthe comprehensive General Plan because the project does not 121 !increase dwelling uni ts. 13 NOW, THEREFORE, BE IT RESOLVED that in view of the above 14ll findings of fact , the Board of Zoning Adjustments of the City of 15l!He rmosa Beach, California, does hereby grant the variance by the 16 I !following vote: 17 11AYES: NOES: 18 I IABSENT: 19 Comms.
