RESOLUTION B.Z.A. 154-320
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY
OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT
2108 POWER STREET, HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach,
at a public hearing held on May 7, 1979 in the Council Chambers of the
City Hall, considered the request of Mr. and Mrs. Edmund F. Sullivan
for permission to add more than 40% (67%) to an existing dwelling with
nonconforming 3 1 11" sideyards in lieu of the 5 1 required, and to main-
tain the same nonconforming sideyards with the new addition, on prop-
erty known as Lot 31, Tract 767; and
WHEREAS, at said public hearing, the applicants• representative stated
the applicants would like to add a second story to accommodate their
expanding family; that maintaining the existing sideyards with the
addition .would be more attractive than having a one-foot inset on the
upper level and would have some significant effects on the building
structurally; that the building was conforming when it was built in
1948; that other homes in the neighborhood have the same nonconformity;
and
WHEREAS, at said public hearing, a petition was submitted containing
nine signatures of neighboring property owners in favor of granting
the request; and
WHEREAS, at said public hearing, no one appeared to speak in opposition
to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of
Zoning Adjustments that the variance be granted, subject to conditions,
for the following reasons:
1. That there are exceptional or extraordinary circumstances or condi-
tions applicable to the property involved because this property
was constructed in 1948; at the time 4 1 sideyards were legal, as
evidenced by the plot plan and the existing house plan. To tear
down both sides of the house and reconstruct them on the new side
yard would be such an economic burden that the applicant would be
unable to do so and still construct the remodel. Further, along
with other houses of 4 1 and even 3 1 sideyards in the neighborhood,
the Board feels that they are not aggravating the problem. The
traditional use of sideyards to provide light and air and to allow
emergency personnel around the house would not seem to be inhibited
by the applicant constructing above the existing sideyard or in
front of it. The applicant has agreed to a deed restriction.
2. There are a number of two-story houses built with 4 ft. or less
side yards within the area of Power Street. This indicates that
the applicant would be denied a substantial property right that
is being enjoyed by others in the same vicinity and zone.
3. That the granting of the variance will have little or no effect on
the public welfare. Since the property is already constructed too
close to the property line, constructing over it would have no
effect on the public welfare. Further, since moving wall to the
existing setback will create a very odd looking structure, it
would be in the best interests of the public to allow convential
two-story construction rather than force an unnecessary and
unsightly setback. The property will maintain R-1 standards due
to the deed restrict ion for single family usage.

4. The granting of such variance will not adversely.:affect the compre-
h~nsive ~Geri~ra~·Plin because the present usage and the antieipated
usage are R-1 single family and the granting of the variance has
no effect on the comprehensive General Plan.
AND, FURTHER, that the variance is granted subject to the following condi-
tion:
1. That a deed restriction be required limiting the property
to single family usag~.
NOW, THEREFORE, BE IT RESOLV~D, that in view of the above findings of
fact, the Board of Zoning Adjustments of the City of Hermosa Beach does
hereby grant the variance request by the following vote:-
AYES: Comms. Beard, Cummings, Chmn. Ebey
NOES: None
ABSENT: None
ABSTAIN: Comm. DeBellis

by the Board of Zoning Adjustments of the City of Hermosa Beach on the
