HomeMy WebLinkAboutBZA Resolution 154-321 - (2 2nd St)RESOLUTION B.Z.A. 154-321 ll l A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH, CALIFORNIA, GRANTING A VARIANCE ON PROPERTY LOCATED 2 IIAT #2 -SECOND STREET, HERMOSA BEACH, CALIFORNIA. 3 WHEREAS, the Board of Zoning Adjustments of the City of 4 11Hermosa Beach, at public hearings held on May 7, 1979 & June 4 1 5 11 1979, in the City Hall Council Chambers, considered the request of 6l!Roy G.E. Ford for permission to enlarge windows to an existing 7 1l four-unit building with nonconforming use, on property legally 81 ldescribed as Lot 7, Block 2, Hermosa Beach Tract; g WHEREAS, as said public hearing, the following facts lOli were presented for consideration: that the structural alterations lli lconsist of enlarging four windows to an existing nonconforming 12 building which was built in 1944 (four units on a lot but present 13 zoning would allow only three units); and that other improvements 14 l1 are of a cosmetic nature and do not require a variance; 15 WHEREAS, at said public hearing, the applicant stated 161ithat he wanted to improve the building and improve the view; 17 WHEREAS, at said public hearing, no one appeared to 181l speak in opposition to the project; 191 I WHEREAS, after due consideration, it is the opinion of 2O1 1the Board of Zoning Adjustments that the variance is granted for 211 1 the following reasons: 22 11 1. That there are exceptional or extraordinary circumstances or 23 conditions applicable to the property involved because at the time 24 of construction, the use was proper; and the variance is very mino 25 in nature, even though it involves some structural alteration. 26 2. That such variance is necessary for the preservation and 27 enjoyment of a substantial property right possessed by other 28 property in the same vicinity and zone because there have been 111 some major structural alterations done to old buildings in the 2llarea; there is precedent; and replacing windows is technically 3l l considered structural, but in this case it is not significant. 4 113, That the granting of such variance will not be materially 5l l detrimental to the public welfare or injurious to the property or 6 llimprovements in such vicinity and zone in which the property is 7lllocated because it does not affect the properties in the surroun- S li ding area; alterations are minor. 9 114.
